cleco is being shafted
heres the latest in the city of alexandria v cleco lawsuits. there are so many and we have blogged about this before to try and recap and someone correct us if we are wrong, cleco has been accused of cheating alexandria "ratepayers" by over charging alexandria for utilities. or something like that. it all started when some guys that worked for cleco sam sansing and david pugh squealed to the city that cleco was frauding it.
as you can imagine, cleco is suing these two in state court and there is controversy there because the judge in that suit judge george metoyer well his wife works for one of the litigants - the city of alexandria. see new judge wastes no time joining the old boy network.
so then it turns out that there was some spies on the citys side because mayor randolph fired his chief of staff and two other high level city "executives" for giving cleco a heads up about what they were discussing in "secret" city council meetings. they turn around and sue and randolph hires charlie weems to defend the suit. mr weems promptly moves the suit to his law partners court who just happens to be a federal judge. how convenient.
anyway, our interest lies as you can tell in all the lawyers involved. you see judge dee drell comes from the gold weems law firm and so does the other federal judge u s district judge f a "pappy" little, jr. "the gold firm" is located here at alexandria, la., charlie weems comes from the gold firm as well. in fact the secretary of state used to list the incorporators of the gold weems law firm as c.s. weems, III and f.a. little, jr.
of course the right thing to do under say oh canon 2 of the federal canons of judicial conduct would be for judge drell as well as judge little to recuse themselves from any suit that their former or current law partner(s) would bring on before em. didnt we just go over this in the alito hearings?
naturally the local press never reports any of this. a few years ago judge little ruled on a lawsuit concerning bayou robert. judge little also lives on bayou robert despite that he ruled anyway. the town talk never mentioned the judge lived on the very property he was ruling on despite publishing several articles about the dispute itself; when it was pointed out to them their reply was "he has to live somewhere"
another one of the lawyers the one representing one of the guys mayor randolph fired is jock scott who is the son of the late federal u s senior judge nauman s scott.
so what we have is a cabal of lawyers who happen to control the federal throne here, poised, to take over a major louisiana utility - cleco. uh huh they are republicans too...
City, Cleco agree to audit to help resolve dispute

Alexandria and Cleco Corp. have agreed to an audit overseen by a U.S. District Court judge to resolve the legal and public argument over whether the utility owes the city's electricity users money.
City Council members Friday unanimously voted to adopt guidelines that will be submitted to Judge Dee Drell, who is presiding over the city's lawsuit against Cleco filed this past summer.
"The audit process provides an opportunity for a neutral and experienced auditor to identify the specific claims that the city has against Cleco," City Attorney Kelvin Sanders said at a special council meeting Friday.
"The audit and resulting mediation has a good chance of expediting a resolution of the city's claims with minimal cost and should improve the city's ability to assess the value of its claims," Sanders said.
In the city's lawsuit, Alexandria makes numerous allegations against the utility, including alleging fraud over years of electricity transactions.
An audit "is the right thing to do," Mayor Ned Randolph said.
Council President Charles F. Smith Jr. said, "We want the people of this town to know we're not hiding anything."
The city suit against Cleco is one of three now in the courts involving the utility, Alexandria and a bevy of other players. The longest-running lawsuit, filed by Cleco against two former employees, is ongoing.
Attorneys for the former employees, Sam Sansing and David Pugh, who brought alleged Cleco wrongdoings to city officials' attention in the spring of 2004, said they will proceed fighting for their own audit in state court.
The most recent case, filed in September, was brought against the city after Randolph got rid of three longtime city executives, Harold Chambers, Sonny Craig and Darrell Williamson.

Annoying someone via the Internet is now a federal crime.
we saw this the other morning on spelunking through the chaos and posted it without comment. what is there to say except that we arent surprised in the tiniest bit to see that this would have pennsylvania's senator arlen specter slimy fingerprints all over it..this guy is for or authors every two-bit piece of corporate, police state nazification of america "legislation" they can come up with; wisconsin's congressman james f sensenbrenner, is another, oh and lest we forget utah's senator orrin hatch. so anyway we louisianaian's will clean our house but you yanks have have to help as well.
ps isnt it creepy how they have done their names a la... specter.senate.gov ... hatch.senate.gov ...while the representatives have theirs at the end.
Perspective: Create an e-annoyance, go to jail
Annoying someone via the Internet is now a federal crime.
It's no joke. Last Thursday, President Bush signed into law a prohibition on posting annoying Web messages or sending annoying e-mail messages without disclosing your true identity.
In other words, it's OK to flame someone on a mailing list or in a blog as long as you do it under your real name. Thank Congress for small favors, I guess.
This ridiculous prohibition, which would likely imperil much of Usenet, is buried in the so-called Violence Against Women and Department of Justice Reauthorization Act. Criminal penalties include stiff fines and two years in prison.
"The use of the word 'annoy' is particularly problematic," says Marv Johnson, legislative counsel for the American Civil Liberties Union. "What's annoying to one person may not be annoying to someone else."
Buried deep in the new law is Sec. 113, an innocuously titled bit called "Preventing Cyberstalking." It rewrites existing telephone harassment law to prohibit anyone from using the Internet "without disclosing his identity and with intent to annoy."
To grease the rails for this idea, Sen. Arlen Specter, a Pennsylvania Republican, and the section's other sponsors slipped it into an unrelated, must-pass bill to fund the Department of Justice. The plan: to make it politically infeasible for politicians to oppose the measure.
The tactic worked. The bill cleared the House of Representatives by voice vote, and the Senate unanimously approved it Dec. 16.
There's an interesting side note. An earlier version that the House approved in September had radically different wording. It was reasonable by comparison, and criminalized only using an "interactive computer service" to cause someone "substantial emotional harm."
That kind of prohibition might make sense. But why should merely annoying someone be illegal?
There are perfectly legitimate reasons to set up a Web site or write something incendiary without telling everyone exactly who you are.
Think about it: A woman fired by a manager who demanded sexual favors wants to blog about it without divulging her full name. An aspiring pundit hopes to set up the next Suck.com. A frustrated citizen wants to send e-mail describing corruption in local government without worrying about reprisals.
In each of those three cases, someone's probably going to be annoyed. That's enough to make the action a crime. (The Justice Department won't file charges in every case, of course, but trusting prosecutorial discretion is hardly reassuring.)
Clinton Fein, a San Francisco resident who runs the Annoy.com site, says a feature permitting visitors to send obnoxious and profane postcards through e-mail could be imperiled.
"Who decides what's annoying? That's the ultimate question," Fein said. He added: "If you send an annoying message via the United States Post Office, do you have to reveal your identity?"
Fein once sued to overturn part of the Communications Decency Act that outlawed transmitting indecent material "with intent to annoy." But the courts ruled the law applied only to obscene material, so Annoy.com didn't have to worry.
"I'm certainly not going to close the site down," Fein said on Friday. "I would fight it on First Amendment grounds."
He's right. Our esteemed politicians can't seem to grasp this simple point, but the First Amendment protects our right to write something that annoys someone else.
It even shields our right to do it anonymously. U.S. Supreme Court Justice Clarence Thomas defended this principle magnificently in a 1995 case involving an Ohio woman who was punished for distributing anonymous political pamphlets.
If President Bush truly believed in the principle of limited government (it is in his official bio), he'd realize that the law he signed cannot be squared with the Constitution he swore to uphold.
And then he'd repeat what President Clinton did a decade ago when he felt compelled to sign a massive telecommunications law. Clinton realized that the section of the law punishing abortion-related material on the Internet was unconstitutional, and he directed the Justice Department not to enforce it.
Bush has the chance to show his respect for what he calls Americans' personal freedoms. Now we'll see if the president rises to the occasion.

Pineville not picture-perfect
My husband and I grew up in Pineville, and after college we moved back to start a family. The town was safe and schools were great. We built a home in a great neighborhood and my parents built next to us.
In our neighborhood you could leave doors unlocked and let children play without worry. What a difference only a few years have made.
Despite the propaganda articles that are printed in The Town Talk, things are not as they may seem. Several years ago the mayor and his professional spokesman were on the front page of the newspaper and on television patting themselves on the back that a new low-rent apartment complex would be built in Pineville right next to our subdivision. They proudly proclaimed that they considered this to be economic development.
I'm not a genius but the "economic" and potential crime impact of this development was not going to be positive at all. The immediate concern to me and other neighbors was people being able to walk into our backyards from the complex. I voiced my concern to our proud mayor and was told that they would get right on it. I wrote letters asking to please, at least, make sure a fence was put up. I was promised something would be done. Unfortunately, I did not have the glare of the spotlight to get the mayor and his staff's attention. Two years have passed and nothing has been done.
In broad daylight on Christmas Eve my family's home was broken into, ransacked and burglarized. Two residents of the "economic development" complex were coming out of my mother's home just as I walked up. My husband and a neighbor caught one suspect after a long chase.
For the first time in my life we have a gun and soon will have a "for sale" sign on the house. Economic development is not showing up for every ribbon cutting or taking credit for every good thing that happens this side of the Red River; it is having a vision that takes into consideration the needs and safety of all the people who live here as well as being responsible to the needs of people when the media are not around. We need less image and more substance from our leaders.

the best tasting show on talk radio
we dont get to listen to this show as much as we would like to. it comes on on saturday mornings on ksyl so we dont always get to listen. when we do get to listen we are never disappointed because chef folse; his assistant michaela york are the perfect foil to each other. they are comfortable with each other and they have a big time, laughing, joking and stirrin it up. they talk about anything and everything.
now we have noticed that chef folse and company are streaming their latest show on his website. tonight, its the show from new years eve and chef has a very hoarse voice he said at the shows opening "the man who needs three women, a producer, a singer, a historian and one chef to carry the show for him today because yall he went to the big game last night - chef john folse." so he has a very hoarse voice but he hangs in there.
anyway, a little into the program michaela was asking the historian they had on about, the feast of christs circumcision. chef folse cut in and said "i never heard anything about that" and after the historian explained that used to be christmas was the holy day everyone went to church then on the epiphany also called the visitation of the magi (which coincidentally is today 06th january) that was when everyone would get their gifts because thats when jesus received his gifts. "yall lucky i cant talk" chef folse cut in ending that circumcision talk lol.
one of their guests and ive probably mispelt her surname was lillian boutet. it was her first time back to south louisiana since katrina from what we could gather she lives in germany shes a singer and she did an accapella version of james taylor's "you've got a friend" ms boutet said its "...a song for everyone affected by the hurricanes..." and if you would like to hear her excellent rendition we have it here.
2006 is also stirrin it up's 10th anniversary year.

Rhode Island Becomes 11th Medical Marijuana State
this is a pretty interesting story. it seems that the rhode island legislature overrode their governors veto and legalized medical marijuana.
its pretty strange when you think about it - making illegal a plant that occurs naturally. we wonder what it would be like if say smoking oak tree leaves or acorns had the same effect instead of marijuana.
how would the government handled that? lol

House overrides Carcieri's medical marijuana veto

PROVIDENCE, R.I. --Rhode Island on Tuesday became the 11th state to legalize medical marijuana and the first since the U.S. Supreme Court ruled in June that patients who use the drug can still be prosecuted under federal law.
House lawmakers voted 59-13 to override a veto by Gov. Don Carcieri, allowing people with illnesses such as cancer and AIDS to grow up to 12 marijuana plants or buy 2.5 ounces of marijuana to relieve their symptoms. The law requires them to register with the state and get a photo identification card.
Federal law prohibits any use of marijuana, but Maine, Vermont, Alaska, California, Colorado, Hawaii, Montana, Nevada, Oregon and Washington allow it to be grown and used for medicinal purposes.
The U.S. high court ruled on June 6 that people who smoke marijuana because their doctors recommend it can still be prosecuted under federal drug laws.
Federal authorities conceded they were unlikely to prosecute many medicinal users, and Rhode Island lawmakers pressed on, passing their medical marijuana bill on June 7.
Carcieri vetoed it, and the state Senate voted the next day to override his veto, but the House recessed before following suit. Tuesday's House vote came just before the start of the 2006 session, allowing the law to take effect immediately.
Rep. Thomas Slater, D-Providence, and Sen. Rhoda E. Perry, D-Providence, introduced the legislation last year after watching family members suffer from terminal illnesses.
Perry's nephew died two years ago of AIDS. Although marijuana may have relieved his suffering, he never used it because it was illegal, she said.
Perry said after the vote that she was "very grateful on behalf of my family and my nephew."
Slater has cancer and several of his family members have died from it. He said he doesn't need marijuana now, but it could be part of his treatment in the future.
"I'm sure everybody in this room knows at least one person who would have benefited from medical marijuana," he said before the vote.
Carcieri reiterated his opposition to the bill on Tuesday, saying it fails to provide ways for users to buy marijuana legally and would leave Rhode Islanders open to federal prosecution.
"Users will be forced to purchase marijuana in the illegal street market, putting them at risk and complicating the difficult jobs that our law enforcement personnel must do every day," Carcieri said in a statement.
Warren Dolbashian, 34, of Cranston, said he has used marijuana to relieve symptoms of Tourette's syndrome since he was 17. Marijuana allows him to reduce the amount of other drugs he uses, which helps because those drugs cause fluid to build up around his heart, he said.
Tom Riley, a spokesman for the White House Office of National Drug Control Policy, called the vote "largely symbolic" because of the existing federal law. He said he thought the vote showed "misguided and out-of-touch" views on the harms of marijuana.
"There's this notion from the 60s or the 70s that marijuana is a harmless drug," Riley said. "It's not."
The legislation contains a sunset provision that would cause it to expire on June 30, 2007 if no further action is taken.

The news marks the latest security setback for Microsoft, the world’s biggest software company, whose Windows operating system is a favourite target for hackers.
“The potential [security threat] is huge,” said Mikko Hyppönen, chief research officer at F-Secure, an antivirus company. “It’s probably bigger than for any other vulnerability we’ve seen. Any version of Windows is vulnerable right now.”
The flaw, which allows hackers to infect computers using programs maliciously inserted into seemingly innocuous image files, was first discovered last week. But the potential for damaging attacks increased dramatically at the weekend after a group of computer hackers published the source code they used to exploit it. Unlike most attacks, which require victims to download or execute a suspect file, the new vulnerability makes it possible for users to infect their computers with spyware or a virus simply by viewing a web page, e-mail or instant message that contains a contaminated image.
“We haven’t seen anything that bad yet, but multiple individuals and groups are exploiting this vulnerability,” Mr Hypponen said. He said that every Windows system shipped since 1990 contained the flaw.
Microsoft said in a security bulletin on its website that it was aware that the vulnerability was being actively exploited. But by early yesterday, it had not yet released an official patch to correct the flaw. “We are working closely with our antivirus partners and aiding law enforcement in its investigation,” the company said. In the meantime, Microsoft said it was urging customers to be careful opening e-mail or following web links from untrusted sources.
Meanwhile, some security experts were urging system administrators to take the unusual step of installing an unofficial patch created at the weekend by Ilfak Guilfanov, a Russian computer programmer.
Concerns remain that without an official patch, many corporate information technology systems could remain vulnerable as employees trickle back to work after the holiday weekend.
“We’ve received many e-mails from people saying that no one in a corporate environment will find using an unofficial patch acceptable,” wrote Tom Liston, a researcher at the Internet Storm Center, an antivirus research group. Both ISC and F-Secure have endorsed the unofficial fix.
Microsoft routinely identifies or receives reports of security weaknesses but most such vulnerabilities are limited to a particular version of the Windows operating system or other piece of Microsoft software. In recent weeks, the company has been touting its progress in combating security threats.
