lawsuit claims rpso raided; damaged wrong home in drugs search
the petition of ms. cora howard makes defendants of rapides parish sheriff charles f. wagner, jr. and rpso deputies tracy bender and michael lacour for their actions related to a botched 30 may 2011 execution of a search warrant "on her residence purportedly looking for contraband and illicit drugs."
according to the petition, the search was conducted not long after ms. howard had left to go on a day trip to lafayette.
upon returning from her day trip and discovering that her house had been damaged, ms. howard "inquired to defendants why her residence was forcibly entered into."
ms. howard "was informed that her residence should not have been searched."
ms. howard asserts that "the search warrant was not supported by sufficient probable cause."
so now, as you can imagine, ms. howard wants to be compensated for her property damage and for her pain and suffering.
the petition is filed on her behalf by alexandria, la., attorney malcolm xerxes larvadain and is allotted to ninth judicial district court judge harry f. randow.
