despite being one of two louisiana state senators, (the other being 'doc' hines) who killed hb730, the sweeping 'glass pockets' ethics reform, state senator robert adley, in a story published on 11 october 2007, disingenuously tells the shreveport times "My goal is to set the standard for ethics in the nation by adding to Louisiana's existing laws," Adley said, "complete sunshine in the state budgeting process and income disclosure for elected officials that does not deter good people from seeking elective office."
louisiana old boy politicians like senator adley never cease to amaze. they obviously have no shame and think the rest of us cant remember beyond what we had for breakfast.
thats the only explanation we can think of when state senator robert adley uttered the above line for publication to shreveport times reporter tarah holland. of course a lot of the fault lies with the main stream media for not following up and asking tough questions to begin with. although most if not all of the blame for this must fall not onto the lowly reporter but on the editor's heads for allowing self serving politicians to make such ridiculous and insulting statements with no worry of the main stream media calling them on it.

Adley announced the change Monday in a written statement, tying his party switch to the new administration of Gov.-elect Bobby Jindal. Adley, describing himself as a conservative reformer, said, "I'm excited we have a new governor with the same philosophy, and I want to be as effective as possible in dealing with him."so, somebody is lying. either adley is lying or piyush is lying or the more likely explanation is that both of them are lying.

one interesting note: section m on page 9 of the bill (the bill runs to 19 pages) limits appeals to the first circuit court of appeals only. this is the same court that went along with the fox mckeithen 911 tapes cover-up. if you are the little guy dont expect any help from this court because there is a reason it was chosen by adley and his cronies to be the only court to handle these appeals...

even louisianaians who work in the oil industry see the folly of this bill. nick bouterie the conservative cajun writes in his blog:"I work in the oil business and am a big supporter of the industry, however, these oil companies need to clean up Louisiana properly. A 6 inch deep clean-up will not do. Oil companies have been good for Louisiana’s economy and have helped in coastal conservation programs, such as Shell Oil donating $100,000 to CCA, even in the aftermath of the two organizations being at odds with each other. However, the oil industry needs to be good to our state’s landowners and environment and properly cleaning up their waste is a must. As much as I have defended oil companies, they still do not give a free pass..."
my bossier tells us that State Senator Robert Adley of Benton would prefer that articles regarding his business not reference the fact that he is also a state senator. Adley, of course, owns Pelican Gas Management which negotiates with municipalities for gas supplies.
senator adley is quoted as saying that “i think that’s wise,” in not referring to him as a state senator when discussing his connection to pelican gas management.

Appellants, the State of Louisiana through the Attorney General and Exxon Mobil Corporation, invoke the appellate jurisdiction of this court pursuant to La. Const. art. V, § 5(D), on the ground that the district court declared 2006 La. Act 312 to be unconstitutional.
Pretermitting the merits, we find the issue of constitutionality was not properly raised in this case. In Vallo v. Gayle Oil Company, Inc., 94-1238 (La. 11/20/94), 646 So. 2d 859, this court explained that the unconstitutionality of a statute must be specially pleaded in the district court: Our Code of Civil Procedure does not require a single procedure or type of proceeding for challenging or assailing the constitutionality of a statute. However, the long-standing jurisprudential rule of law is: a statute must first be questioned in the trial court, not the appellate courts, and the unconstitutionality of a statute must be specially pleaded and the grounds for the claim particularized.
The pleadings allowed in civil actions are petitions, exceptions, written motions and answers. LSA-C.C.P. art. 852.Therefore, when the unconstitutionality of a statute is specifically pled, the claim must be raised in a petition (the original petition, an amended and supplemental petition or a petition in an incidental demand), an exception, a motion or an answer. It cannot be raised in a memorandum, opposition or brief as those documents do not constitute pleadings. [emphasis added; citations and footnotes omitted].
A review of the record indicates the issue of constitutionality was first raised in plaintiff’s “Memorandum in Opposition to Motions to Enforce Stay Provision of Act 312 or Alternatively to Extend Time in Which to File Responsive Pleadings filed by Wagner Oil Company and Parawon Corporation.” As explained in Vallo, a memorandum is not a pleading recognized under the Code of Civil Procedure and is therefore not a proper method to challenge the constitutionality of a statute.
Accordingly, we vacate the judgment of the district court. The case is remanded to the district court to allow plaintiffs to specially plead the unconstitutionality of Act 312 and for the issue to be fully litigated. See La. Code Civ. P. art. 2164; Summerell v. Phillips, 258 La. 587, 247 So. 2d 542 (1971).

anyone bothering to watch that video can easily see that rep. dewitt's words were not "antiethics" at all and neither was his speech "against the passage of ethics legislation." in reality it was two louisiana state senators who killed the so called glass pockets ethics reform. those two senators were robert adley and donald "doc" hines.
by the way, the self serving senator robert adley should have had his ass handed to him in this just recently concluded election. however, the gannett controlled shereveport press were remiss in their duties when they failed to remind their readers of senator adleys contempt for ethics reform. not only does louisiana need ethics reform, we need media reform.
its also a lie when mr. beam writes "The House voted for 88-13 for the bill on May 30, rejected Senate changes to the measure on June 26 and voted 51-49 on June 28 to send it back to a conference committee where it died when the session ended. DeWitt spoke against and voted against the bill the first time around and repeated that performance June 28."
the house of representatives roll call vote [one page .pdf] shows that on hb730 on 28 june 2007 rep. dewitt voted yea.
in louisiana we citizens not only have to watch the lying politicians we also have to watch out for the lying media.
dependable piyush media whore john maginnis in his column yesterday repeats the lie that "The Senate refused to exclude local officeholders, the House refused to include them..."
so on the one hand we have jim beam and his mysterious reader(s) already writing off the piyush administration stating “Gov.-elect Jindal will...find himself in the same place as (Buddy) Roemer and (Dave) Treen did when they were out-politicked by the ‘good ol’ boys ..” while on the other hand, john maginnis is assuring us that "what legislators, particularly Democrats, unwittingly accomplished [hb730] was to tee up the [ethics] issue perfectly for candidate Jindal, who made it a compelling but safe platform plank, as did other Republican candidates."

this morning frequent ksyl talk back live caller "becky" phoned in to "challenge all our (local) legislators to come on the air and tell us what kind of bills they're proposing and supporting. i hear some of the most baloney kinds of things going on and i want to know in a time of crisis like this and it is a time of crisis, what are they proposing?"
perhaps some of the "baloney" kinds of bills ms. becky is referring to are ones like state rep. rickey hardy's HB 103 a state law banning "baggy pants."
or his HB 43 which expands "drug free zones" from 1,000 - 2,000 feet. c.b. forgotston says:Why not increase the area to, say, 25 miles. That way, the use and sale of illegal drugs would prohibited almost everywhere in the state. Oops! It already is.
or his HB 470 which is a constitutional amendment barring anyone over 70 years of age from qualifying for elective office. a better constitutional amendment would be one barring all black people from lafayette named rickey hardy from holding any elective office or office of public trust. now thats an amendment we could all get behind!
maybe becky has heard of state senator robert adley's SB 128 which will prohibit the sale of "energy drinks" to consumers under the age of sixteen.

the catty cur is the catahoula parish blog "Watch Dog for Politics and General Information in East Central Louisiana. Seeking economic improvement and better government in Catahoula Parish." they have been fighting the ill advised proposed 5,200 acres [2,194 hectares] landfill in between the banks of the red river and the historic and sacred larto lake. it appears that the proposal is dead. for now anyway. we are unsure what role, if any, any blogs are playing in louisiana politics. however, we did see and hear alexandria's own mayor, jacques roy, mention "the blogosphere" in a recent (27 february 2007) alexandria city council committee meeting.
