    Alexandria attorney Mike Small has instructed Amanda Gutweiler Hypes not to talk to the media for now. Hypes is on her way to or already in Mullens, W. Va., at the home of her parents, Iris and Dally Maynard. That is the address she gave when she bonded out.     Hypes released on $150,000 bail bond
    town talk snip:

    Luke's great aunt, Brenda Perdue, and other relatives who lives in West Virginia became emotional when a Town Talk reporter informed them that a judge had released Hypes. Perdue could not bring herself to comment on the court development.

    J. Mike Small, Hypes' attorney, said "an arrangement was made to underwrite the fee on that bond." That means a 12 percent fee, or $18,000, was paid. Small would not say where Hypes is or who came up with the money.

    the purpose of this post isnt to either defend or condemn amanda gutweiler hypes. whether or not she alledgedly murdered her three children is for a jury to decide. however, we must give credit to 9th judicial district court judge donald johnson for having the courage, albeit unpopular, to defend the constitution and rights of the accused and to reject the district attorney's old boy network style of doing business.

    Hypes' release under advisement

    Amanda Gutweiler Hypes remains in jail, for now.

    The former Tioga mother, who has been accused of killing her three children in a house fire, has remained in jail even after 9th Judicial District Judge Donald Johnson threw out the murder indictments against her.

    On Friday, Johnson took a request under advisement for Hypes' release or her to be released on bail.
    He told attorneys for both sides that written reasons for his decision would be given.

    It is unknown when a decision may be made.

    Attorney J. Michael Small, a member of Hypes' defense team, said he would be surprised if the waiting for a decision from Johnson would go very long.

    Hypes' attorneys requested a release hearing after Johnson determined, among other things, secret grand jury testimony was given to prosecution witnesses and threw out the three first-degree murder indictments.

    Hypes' three children -- Sadie Plumm, Luke Hayden and Jessica Gutweiler -- died in January 2001 in a fire at their home on Friar Tuck Road. Hypes was arrested the following year after a grand jury indicted her on murder charges.

    The hearing Friday focused on testimony of three defense expert witnesses. Small said he was "very pleased" with how the hearing went.

    All three experts countered the findings of experts presented by the prosecution, Small said.

    George Barnes, a retired Alcohol, Tobacco and Firearms fire investigator, testified that his opinion was that the prosecution experts based their conclusions on wives' tales, the crime scene was not preserved and that there was no attitude of impartiality by fire investigators.

    Hypes has remained in jail since her arrest in 2002.

    Arson experts to testify in Gutweiler hearing

    Three arson experts, hired by the defense, will testify in Amanda Gutweiler Hypes' hearing on whether she should be released from prison or have a bond set.

    Lawyers for both sides went into 9th Judicial District Judge Donald Johnson's court Monday to argue whether Hypes should be freed or have bond set. Johnson threw out Hypes' April 2002 indictment.

    Mike Small, Hypes' attorney, introduced into evidence affidavits by three arson experts saying the methodology used by the state was flawed. But Tom Walsh, assistant district attorney, said he wanted the chance to question the witnesses in person. Johnson said there would be a telephone conference call and a hearing would be set once a date for all three could be set.

    George H. Barnes, one of the experts, said, "The fire investigation conducted by the state of Louisiana does not comply with the accepted methodologies utilized and relied upon by the law enforcement and fire investigation communities. Their conclusions that the fire is incendiary in nature and that the defendant was responsible for the fire were made as a result of their use of methodologies that are not accepted by the relevant scientific communities."

    Another expert is John Lentini, part of a team investigating an arson case in Texas. He is working with The Innocence Project, a New York-based group that seeks to reveal wrongful convictions.

    The third expert is Doug Carpenter who was critical of work done by Dr. John DeHaan and Dr. David Icove who did work for the state in the case.

    Johnson threw out the indictment based on the leaking of grand jury testimony to DeHaan and Bobby Sandoval, a Rapides Parish sheriff's investigator.

    Walsh predicted Small would enter the testimony of the three experts via affidavits and deny him cross examination. But Johnson said the three experts would be subpenaed and a full hearing would be held.

    In the meantime, the Louisiana Supreme Court is scheduled to hear an appeal by Small on the refusal to allow the fact that Hypes passed a polygraph test into evidence. That hearing will be May 17 at 9:30 a.m.

    Hypes was charged with murdering her three children -- Jessica Gutweiler, 3; Luke Hayden, 6; and Sadie Plum, 10 -- in a January 2001 house fire. She was indicted in April 2002 and has been in prison since.

    Johnson to place ads in Opelousas paper instead of making trip

    Ninth Judicial District Judge Donald Johnson said Thursday he will not go to Opelousas on Monday to explain why jury selection will not begin in the murder trial of Amanda Gutweiler Hypes.

    Instead, he will place newspaper ads in the Opelousas Daily World, he said.
    After talking to the chief judge in the 27th Judicial District Court covering St. Landry Parish, Johnson said it was not necessary for him to go to Opelousas. Jury selection was scheduled to start Monday.
    However, Johnson threw out the indictments on April 6 because he said grand jury testimony had been given illegally to the state's expert witness and to a sheriff's deputy.

    "I didn't want jurors to take a day off from work only to find out the selection wouldn't start," Johnson said.

    He said he was convinced that most will find out through the newspaper ads, by calling to check, or by word of mouth.

    His decision to throw out the indictments has been appealed to the 3rd Circuit Court of Appeal in Lake Charles. Whoever wins there, the losing side then probably will appeal to the Louisiana Supreme Court.

    Hypes is charged with first-degree murder in the January 2001 deaths of her three children -- Jessica Gutweiler, 3; Luke Hayden, 6; and Sadie Plum, 10. She was indicted in April 2002 and has been in jail ever since.

    Assistant District Attorney Tom Walsh is seeking the death penalty.

    Mike Small, Hypes' attorney, is seeking to have his client either released because there is no indictment or to have her bond set.

    Small asks for release of Hypes or reduced bail

    Amanda Gutweiler Hypes' attorney, Mike Small, has filed a request seeking either her immediate release from jail or a reduction in bail after her indictment on three counts of first-degree murder was thrown out last week.

    Small said Hypes has been incarcerated for nearly four years on the basis of an "illegal indictment."

    "She is entitled to be released," he said Thursday.
    On April 6, 9th Judicial District Judge Donald Johnson threw out the indictment, ruling the state had illegally disclosed grand jury testimony of a key state witness to Dr. John DeHaan, its expert witness. Other grand jury testimony was given to Rapides Parish Sheriff's Detective Bobby Sandoval, the judge said.

    He further ruled that the two cannot testify against Hypes.

    Small noted that the state is appealing the ruling to quash the indictment, rather than issue a new indictment. He said "it is not possible" to know how long that will take.

    Tom Walsh, the assistant district attorney prosecuting the case, could not be reached for comment Thursday. Today is a state holiday.

    Hypes is accused of killing her three children -- Jessica Gutweiler, 3; Luke Hayden, 6; and Sadie Plum, 10. They were killed in a January 2001 house fire. She was indicted in April 2002.

    Gutweiler case continued

    The trial of Amanda Gutweiler Hypes on three charges of first-degree murder was formally continued Monday by 9th Judicial District Judge Donald Johnson who said he would personally go to Opelouas April 24 to tell prospective jurors.

    Mike Small, Hypes' attorney, and Tom Walsh, lead prosecutor, were in Johnson's court Monday for motions, but since Johnson threw out the indictments Thursday, there technically is no indictment. "It's obvious that this trial will not go on April 24," the judge said.

    He said he would go to Opelousas to present "a statement of the case."
    The state plans to appeal Johnson's action, and it has 30 days to do so. Then the defense has time to respond. Besides, whichever side loses at the 3rd Circuit will appeal to the Louisiana Supreme Court, and that will take even more time.

    So, all motions are on hold until the appeals are exhausted.

    In the meantime, Hypes remains in jail pending outcome of those appeals.

    She is charged with killed her three children -- Jessica Gutweiler, 3; Luke Hayden, 6; and Sadie Plum, 10 -- in a January 2001 house fire. She was indicted in April 2002 and has been in jail since.

    The case was originally assigned to Judge Harry Randow. When the court realigned last year, the case was assigned to Judge Tom Yeager. But the 3rd Circuit found the court had not followed its own rules on allotments, and the case ended up with Johnson.

    On Thursday, Johnson threw out the indictments on the grounds that grand jury testimony was given to two state witnesses without permission of the court.

    Kate Williamson, who is working on the case with Small, said Walsh's "actions clearly violated long-standing Louisiana law and left the judge with no choice but to throw out the indictment. There is ample support for the court ruling ...," she said.

    Walsh maintains his actions were proper and predicted strongly that he would be upheld on appeal.

    Indictment against Amanda Hypes quashed

    Ninth Judicial District Judge Donald Johnson today threw out the first-degree murder indictment of Amanda Gutweiler Hypes in the deaths of her three children, ruling that grand jury testimony was turned over illegally to an expert and a sheriff’s deputy.

    Johnson said the evidence showed Tom Walsh, the Rapides Parish prosecutor in the case, turned over grand jury testimony to Dr. John DeHaan, an expert in arson, and Rapides Parish Sheriff’s Detective Bobby Sandoval. The judge said Walsh’s actions violated state law since they weren’t done with court approval.

    Johnson also ruled that DeHaan and Sandoval cannot testify in any future proceedings against Hypes.

    Further, the judge ruled that Walsh should be held in constructive contempt of court for violation of court rules on criminal procedure. That show-cause hearing will not be scheduled until the appeals in the case have been exhausted, the judge said.

    Walsh said Thursday that Johnson’s ruling is “unprecedented” and that “his reasoning is flawed.”

    “I think that it is wrong. I haven’t said this one time in 21 years of prosecuting, but I guarantee the appellate court is going to reverse it,” Walsh said.

    “It’s the worst opinion I’ve seen – it has no basis in law. All he’s doing is setting up an artificial roadblock in our attempt to bring her to justice. He is a judge, so I am not going to say anything disrespectful,” the prosecutor said.

    Mike Small, Hypes’ attorney, said Thursday that he felt “good about this opinion.”

    “We are legally correct. Grand jury secrecy is long-standing and very, very rigorously enforced,” Small said. “The violation is so clear, it’s problematic.”

    Walsh said the April 24 trial date is probably off. Small didn’t go that far, though he did say motions are scheduled Monday before Johnson. But there’s now no case, Small said.

    Hypes is accused of killing her three children – Jessica Gutweiler, 3; Luke Hayden, 6; and Sadie Plum, 10 – in a January 2001 house fire. She was indicted in April 2002 and has been in jail ever since. She will remain in jail until the appeals are final.

    District Attorney Jam Downs said the state will appeal to the 3rd Circuit Court of Appeal, and if it isn’t satisfied there, it will take the case to the Louisiana Supreme Court.

    rapides parish district attorney trots out amanda gutweiler hypes in time for 9th judicial district court election


    it seems awfully coincidental that just a few days before a ninth judicial district court judgeship runoff election which pits an assistant district attorney (rocky willson) against a popular local lawyer (mary lauve doggett) that the rapides parish district attorneys office would choose to bring this case back into the public eye.

    in 2001 when this case started, the district attorneys office was bragging about how they were going to get the death penalty for ms. hypes and they were going to do this and do that....then the district attorneys office was caught leaking secret grand jury testimony to one of their expert witnesses and a rapides parish sheriff's detective -- presumably so that they would have their stories straight to pitch at trial.

    only they got caught and the trial judge threw the indictment out.. the third circuit and the state supreme court mostly upheld the judges ruling.

    no investigation was ever conducted to punish anyone by finding out just how this happened, how common this practice is or how many times in the past it's been done to others less fortunate. -- this is louisiana after all.

    now the district attorneys office is back with even less severe charges than what they originally filed.

    people would be foolish to promote anyone from this district attorneys office especially to a position as important as a district court judgeship.

    this was a pretty decent report by kalb's mike magnoli...until the end when he states "and to this date the question remains, who authorized the demolition of the burnt house? how could so much potential forensic evidence be destroyed?" apparently, this morning mr. magnoli had read the 7:17 am post by a town talk story chat commenter, savy1 who observed:

    Can anyone shed some light as to why the burned out home was bulldozed the next day?

    Why didn't law enforcement secure the scene?

    Who drove the bulldozer?

    Who gave the OK to destroy the house?

    Someone dropped the ball on this one...big time!
    the thing is, is that mr. magnoli had both of the assistant district attorney's involved in this disaster on camera, so why didnt he simply ask them these questions? or while he was in the court house pull the case file and find out for himself? mr. magnoli -- be a reporter not a repeater.

    STATE OF LOUISIANA v. AMANDA GUTWEILER AKA AMANDA HYPES (Parish of Rapides) (First Degree Murder - Three Counts)

    For the foregoing reasons, the judgment of the court of appeal is affirmed in part and reversed in part. The decision is affirmed insofar as it holds the indictment was properly quashed for the State's violation of grand jury secrecy by the release of a witness's grand jury transcript to its arson expert witness; the ruling prohibiting Dr. John DeHaan and Det. Bobby Sandoval from testifying in any future grand jury proceedings or prosecution of the defendant is reversed. This case is remanded to the district court for further proceedings consistent with the views expressed in this opinion.
    AFFIRMED IN PART, REVERSED IN PART AND REMANDED.

    this cant be good....the rapides parish district attorney's office was caught leaking secret grand jury testimony to a sheriff's deputy bobby sandoval and to dr. john dehaan a so called 'expert witness' so they would know what story to pitch in ms. gutweiler-hypes trial. ninth judicial district court judge donald johnson threw the charges against ms. gutweiler-hypes out and the third circuit affirmed.

    now, we see that the state supreme court wants to weigh-in for what reason remains to be seen. with the duke rape case over in north carolina we saw the district attorney there disbarred and sent to jail for misusing his office. in louisiana nothing happens to a district attorney with a propensity for railroading. in fact, in state of louisiana v leslie otto ordodi the louisiana supreme court judicial monkeys ruled that merely thinking about a crime -- not actually committing a crime, was reason enough to arrest, convict and sentence someone to many years in prison.

    On the 14th day of September, 2007, the following action was taken by the Supreme Court of Louisiana in the cases listed below:

    according to mr. small, ms. gutweiler-hypes who appeared today before judge john c. davidson, is free to go and has left.

    she received no fine. mr. small said that the rapides parish district attorney's office agreed to the deal.


    mr. small said that all this means that the case is finally over.

    hb148 more wasteful farrar legislation

    the problem with louisiana is that the people in the legislature dont have any sense. well thats not entirely accurate, they have sense they just dont use it for good purposes. they dont use their sense for the well being of the people of the state. they use their sense which in their case is more accurately called "craftiness" to benefit themselves and those in their respective crime gangs.

    we know its an election year for representative rick farrar and so it must be a lot of assistant districts attorney in rapides parish with big families and voters that live in his district - dist. 27. even so the districts attorney are the laaaaast people that need a pay raise. in fact they should be investigated not given a raise.

    we just saw less than a year ago in the amanda gutweiler hypes case, how the rapides parish district attorney broke all kinds of laws and ethics rules when his office leaked secret grand jury testimony to their witnesses - one being a deputy sheriff so they would know which story to pitch at trial to ensure an easy conviction. we're not making this up - judge donald johnson threw the indictment out and the third circuit court of appeals sided with the judge.

    thats another thing - we see over in north carolina in the so called duke rape case how that district attorney is in all kinds of hot water over his actions in that case, yet...over here in the banana republic of louisiana our district attorneys actions didnt raise an eyebrow with those who are charged with overseeing the courts integrity. why do you suppose that is? the district attorneys office wasnt ashamed of their behaviour at all they practically called judge johnson a dumbass for quashing the indictment. and representative farrar thinks this warrants a pay raise? rubbish! what does the rapides parish district attorney do now to deserve the pay that they do receive? you never see the district attorney investigating any white collar crime arising out of rapides parish, louisiana.


    this bunch of horseshit isnt just limited to rapides parish either, as we saw a few years ago when the winn parish district attorney managed to get a guy sentenced to prison for seven and half years at hard labor for growing one marijuana plant - in a bucket. it was only about four feet tall so they didnt even know yet if the plant was a male or a female. from what we have been able to gather, male plants are worthless; its the female plants that produce the smokable part.

    now even if you are totally opposed to marijuana - and thats fine, think of all the tax money wasted to incarcerate this guy for seven and a half years, when five, ten, fifteen or thirty days tops in the parish jail would have been more than enough punishment.

    if representative farrar truly was representing the people and had the peoples best interest at heart he would (1) be leading the charge for the district attorneys office to be investigated for the amanda gutweiler hypes incident and (2) he would introduce a bill making it mandatory for all the city's, parishes, police jurys, water boards, levee boards etc... video tape, archive and stream their meetings from off their websites; (3) he would introduce legislation overturning the state supreme courts disastrous ruling in state of louisiana v leslie otto ordodi. wouldnt that be more beneficial to the people? or does that make too much sense?

    will mike small bring down the rapides parish district attorney...

    it looks pretty good that mike small can prove corruption on the part of the rapides parish district attorney.

    according to court papers that small filed in behalf of his client amanda gutweiler hypes, *tom walsh leaked grand jury testimony of hypes to expert witnesses without first obtaining the courts consent. and of course if he went to get the courts consent he would have to give notice to small and small would have opposed it. so the rapides parish district attorney took a shortcut. after a lot of legal wrangling thats been featured in the town talk small has filed a motion captioned "We call the bluff" in this motion small called out the rapides parish da for: "astonishingly unprofessional and inappropriate manner." apparantly the gist of it all is that the point of the leak was so dr john dehaan and bobby sandoval a rapides parish deputy sheriff would know which story to pitch at trial.

    notice in this article rocky willson is now speaking for the da office he must have taken over the case because a fellow ada practically called judge donald johnson a dumbass. why didnt they just follow the law and go through the motions? what gives them the right to decide to just arbitrarily break one law to enforce another? the truth is ms hypes should have been tried ages ago. its ridiculous for her and her families and for us too that someone should be in jail so long. if the state is so sure of its evidence that they were once talking about the death penalty. why take so long to present it? it looks like you are trying to manufacture it. and that brings us back to the title of our post. will the public be so outraged at the actions of the da's office in screwing this up so bad, translate to change at the polls? sheriff hilton is retiring too. maybe this is time for sweeping change.

    august the 29th is more this year than just the first anniversary of hurricane katrina. this is long awaited appeal hearing in which it will be decided whether or not ninth judicial district judge donald johnson erred at 06 april 2006 when he ruled to quash ms. gutweiler-hypes 1st degree murder indictment. ms. gutweiler-hypes was subsequently released from jail on bond at 29 june 2006. we still think that judge johnson's ruling will be affirmed.

    we have to note that "katrina" means cleansing or purifying and we have to wonder if its a sign that the decision reached from the 29 august argument will indeed help to purify and cleanse an incompetent and corrupt rapides parish district attorneys office?

    do-nothing d.a. downs to run for reelection

    this morning the town talk is reporting that rapides parish district attorney james c. "jam" downs will stand for reelection in the fall of 2008.

    amazingly, district attorney downs attempts to sex up the amanda gutweiler hypes case. the very case that spotlighted district attorney corruption and incompetence.

    district attorney downs sees "nigger" and poor white trash drug dealers and criminals everywhere. yet, turns a blind eye to all his crime gang pals in the governmental and white collar crime bidness who are behind it all.

    what a joke.

    robbing the bank twice


    the prestridge crime family

    we came across this interesting 3rd circuit opinion from trolling the la state supreme court's website mostly looking for a decision in the amanda gutweiler hypes case. we arent sure but seems like there are opinions waiting in her case before both courts. scrolling down through the writ applications denied section the name glynda prestridge caught our eye because anytime you see the name (glynda or larry wayne prestridge) you should further investigate because something funny going on. heres why:


    the prestridge family own a company at alexandria, louisiana called air conditioning- appliance corporation or as its commonly known as aca corp. website.

    a few years ago the son larry ray prestridge shot and killed a man named darryl gates at a rural area of rapides parish in the philadelphia community called morris sasser road [map] [satellite] this received scant attention in the local press. naturally, the prestridges hire local super lawyer j michael small to represent their scion.

    due to the incompetence or collusion (pick one) of the local sheriff department and district attorney, ninth judicial district judge george metoyer ruled that there wasnt enough evidence to sustain the charges and dismissed them. larry ray prestridge walked out of court that day a free man getting away with murder.

    if you view the aca website today you will see him standing there in the middle with a smile.

    a little while later his mother glynda prestridge opens an account at a local bank - the bank of jena, libuse, branch with a deposit of at least $61,000 [48,332 eur] which she claims is the proceeds of a loan her son larry ray was paying back (probably the money she loaned him for mike small's legal fees.) according to mrs. prestridge she claims that she never bothered to check her bank statements until some months later only to discover that her daughter in law (larry ray's wife) had been forging checks and had withdrawn around $60,800 [48,170 eur].

    so glenda prestridge decides to sue the bank to get her money back despite by her own admission she never bothered to check her bank statements till months later and that the bank faithfully mailed her the statements on time like they were supposed to.

    local attorney aaron siebeneicher must have felt like a fool bringing on such a ridiculous argument before the court fortunately for siebeneicher the judge in the case was none other than... george metoyer!

    the prestridges have a long history of conduct like this. some years back larry wayne prestridge together with a fellow named jack hodnett and their um lady friend nola mcfalls swindled a lowly school teacher named billy hooper out of his life savings in a company called ptq enterprises, inc. hooper discovered that mr. hodnett and mrs. mcfalls were embezzling money from the company and despite owning thirty percent of the companys stock was promptly "fired" from the company. hooper had a heart attack and died and these three criminals are still ripping off his poor widow.

    larry wayne prestride is also a deacon in a local southern baptist church philadelphia baptist church in the philadelphia community. the church body as well as the community as a whole know that he is a criminal yet they still reelect him to the deaconship. we guess this church is full of what jesus referred to as "vipers"

    oh and the law firm that assists in the ptq swindle why none other than charlie weems and the so called gold law firm.

    we have to wonder just what the hell is wrong with our sheriff department, our district attorney and our ninth judicial district court judges -- oh yeah one part the town talk conveniently left out of their story about the club retro (operation retro-fit) raid that they splashed across the front page of the paper last year was that the sheriff department had ninth judical district court judge john c. davidson (paragraph 44 pg.18) tag along with their raid. now how many times do you hear of a sitting judge going along on a police raid?

    then a couple of days later the sheriff's department learned that club retro had a surveillance camera system that had caught the whole raid on tape. so under the guise of a "search warrant [we wonder which judge signed off on this search warrant] for any electronically or digitally stored images intending to prove the ownership, transportation, sale or profits from illegal controlled substances or drug activities, etc.," (paragraph 48 pg.21) they go back to the club to seize the video tape -- which that right there should tell you that the raid was bogus and designed to intimidate. if it was a legitimate raid then why didnt the sheriff department go into the room where the video monitors are kept? why didnt anyone see the cameras? but much to what we're sure was the sheriff departments chagrin the tapes "had been taken to a safe place where they were safe from getting “lost.”

    no one is suggesting that a true criminal should be given a pass but if the sheriff, district attorney and the rest of the courthouse crowd cant make a criminal case against one under the guidelines set forth under the united states constitution -- then guess what -- they are not a criminal. you do not have the right to use the power of your office to arrest someone and to destroy their business just because you dont like the way they look, the color of their skin, the kind of music they listen to or because they are competing with your pals business.

    some may say this is just a couple of black guys with a bar so what? well a lot so what. if they would do this to them, whats to stop them from doing it to you or yours. after all, remember they did it to amanda gutweiler hypes and she is a white woman.
