city of amite and johnny duncan settle his 'racial slur citation' complaint
johnny duncan received a citation for this sign which reads "you might be a nigger!" the title of his book which the sign, displayed on the side of his automobile, was helping to advertise.
johnny duncan writes wst...:UPDATE: New Orleans--On Thursday parties reached a settlement in this case. The terms are confidential. The defense lawyer say that it was a business decision with the City of Amite categorically denying everything or any harm to Duncan.
Duncan countered that while he worked in the Colorado Department of Corrections, he met few convicted criminals who didn't categorically deny their crimes.
It is ironic that the only way to bring attention to the discriminatory practices of this small town police department is by the use of the "n word", a term originally used by traditional white racists to denigrate black slaves.
The settlement of this case gives the Black citizens of Amite hope that they can prevail against the conditions here.
On Tuesday June 16, 2009, they met with the police department to voice complaints about the tactics and harassment of policemen.
Chief Trabona defended the officers as only doing their job. The crowd was told to pursue legal action if they felt they were illegally treated.
Little did those in attendance know that two days later Duncan would prevail in a precedent setting case against the police department for the very reasons that they were then in session.
When I was commissioned a 2LT in 1982, I took an oath to uphold and defend the Constitution of the United States against all enemies, foreign and domestic. This litigation fulfills that oath, and my word remains my bond!

aclu to represent johnny duncan in his federal complaint against the amite, louisiana police department
johnny duncan is an author who self published a book titled "you might be a nigger!" to help advertise his book he placed a sign with its title and his contact information on the side of his car.
subsequently, the amite police department ticketed him "for displaying an obscenity on his car."
according to the times-picayune (see link) the ticket was later dismissed. we might add and rightfully so.
now, mr. duncan is suing the police department in federal court. good!
as former police officer turned anti-drug war activitist barry cooper has pointed out, one way to help stop police abuse is to sue them. so we wish mr. duncan well with his complaint.
note: a lot of people complain about the aclu. but why werent there any "honest, respectable" attorney's willing to step-up to the plate and go to bat for mr. duncan?

the amite, louisiana police department is ignorant
UPDATE: 23 january 2009: aclu to represent johnny duncan in his federal complaint against the amite police department
more proof that louisiana's law enforcement is a total joke and an ass. instead of investigating something worthwhile, like oh say, political and governmental corruption, the amite, tangipahoa parish, louisiana police department shows the world its total incompetence and disregard for the first amendment of the constitution, by ticket harrassing one mr. johnny duncan.
according to wafb: "johnny duncan is a veteran of the civil rights movement in the south, particularly in the florida parishes in the seventies. he has written about that in a self published book of life experiences, poems, essays and historical surveys that offer credible insight into the black experience including the birth of the 'n' word."
mr. duncan has written a book titled "you might be a nigger!" (notice how the poltroon's at wafb trying to be politically correct, commit journalistic fraud by blotting out most of the word that is the reason for the story to begin with!) so in order to help advertise his work, put a sign on his car. someone called in to the amite police department complaining that they were offended by the word nigger on the sign.
so the amite police department always eager to please every nut case who calls in some silly complaint, pulls over mr. duncan and gives him "a ticket for displaying an obscenity on his car." amite police chief jerry trabona, this clown actually says that "we'll let the judge decide whether this will be prosecuted or not. it'll go to court. what we see, we think it needs to go to court and then we'll let the judge decide"
