congressman rodney alexander "live telephone town hall meeting" 26 march 2012

around 6:30 pm cdt on monday, 26 march 2012, we received another phone call from congressman rodney alexander.

fortunately, his office has -- at least this time, modified their caller id, call display information so that when "congressman rod" with an area code 318 number popped up on our caller id display, we pretty much knew that the call was either another one of his "live telephone town hall meetings" (we prefer the phrase telephonic town hall) or a political robo call, either one potentially blog-worthy. so we switched on our recording device.

====
one question that piqued our interest is around the 10:13 mark where the questioner from west monroe, la., wanted to know congressman alexander's stance on semi-automatic firearms and that one of his "real concerns is if obama is reelected, he's gonna do his darnedest to get those away from us."

congressman alexander said that he believes in the 2nd amendment and that he has "automatic firearms" in his house -- "and dont need to do anything to restrict it."

the interesting part is where the congressman says that:
"i even read an article today, not sure where it came from, i need to go back and check and see, that indicated that perhaps there is a very wealthy individual in the nation that is buying some of the firearms companies with the sole purpose of cutting back and restricting sales to individuals.

just limit the sales of the firearms companies to the government, police force or the military, so forth.

i dont know whether there is any validity to that or not -- but we do know that there are people out there including the administration that would like to see fewer firearms available to law-abiding citizens and i think it's clear that our forefathers and the founding document -- the constitution, clearly indicated that they felt like one should always continue to have the right to bear arms.

so, i'm there. i've got my lifetime nra card in my wallet right now and wont do anything, will not vote for any measure that dilutes the strength of the second amendment."
while we continue to oppose any and all forms of gun control or bullet control and believe that the citizenry should and must have access to the same firepower that the military and police has (or else what's the point of being armed?) our view of the second amendment and the right wing gun nuts is evolving.

the following excerpt from a recent eric hufschmid essay pretty much sums up our thinking on the subject:
Conservatives are not "tough on crime"

The conservatives boast that they are honest people who are "tough on crime", but they are only tough on crimes that other people commit, especially people of other nations or races.

They are extremely lenient on the crimes that conservatives commit, such as financial fraud, pedophilia, price-fixing, and cheating on taxes.

Barney Frank was elected to Congress by liberals, so we cannot blame conservatives for that. However, an orphan boy testified in court that Frank was just one of many men in leadership positions who were raping orphan boys, but as far as I know, not one conservative proposed that the conservatives take their guns to Congress and arrest Barney Frank and all of the other pedophiles.

Why are the conservatives so tough on black people who smoke marijuana or use cocaine, but they don't do anything about the pedophiles in the government or the Catholic Church?

Incidentally, the issue of Barney Frank and pedophilia should be used as more evidence of how worthless it is to let citizens own guns.

There are millions of conservatives in America with guns, but when are they going to use them?

Crime is rampant in this nation, and corruption is everywhere in government, schools, businesses, and churches.

Larry Silverstein is still walking around freely in New York City.

When are the conservatives going to get together and use their guns to eliminate crime?

The answer is, never.

The conservatives are not interested in standing up to criminals, eliminating government corruption, or analyzing world events.

They want guns for defensive purposes only.

They are like a frightened animal that is hiding in the bushes.

They do not even have the courage to face Barney Frank.

Kay Griggs claimed that Henry Kissinger raped some American soldiers, but what do the conservatives do about that accusation? Nothing!
one instance in which we disagree with mr. hufschmid's analysis is that the reason american's do nothing about crime and especially corruption, is because they are psychologically disarmed.

this explains why americans have sat back for decades and accepted every unconstitutional, immoral, freedom killing law, rule, regulation and ordinance from the federal, state and local governments without so much as a whimper.

all this, despite being the most heavily armed and violent nation of people in the history of the world.

if that's not psychologically disarmed we dont know what is; we've said it before and we'll say it again: "america, land of the free and home of the brave," is just a meaningless marketing slogan.

congressman rodney alexander telephonic town hall meeting

congressman rodney alexander, apparently stealing a page from the david vitter playbook.

tonight we received what we thought at first glance at the caller id was going to be a robo or sales call to learn that it was an invitation to listen and participate in congressman rodney alexander's live telephonic town hall meeting.

we didnt bother to try and ask a question or participate in any of the polls and as with david vitter, we do not support this treasonous, traitorous rat.

however, we do find these events to be pretty ingenious and think that more politicians at all levels local, state and federal should put them on.

senator david vitter live telephonic town hall meeting

we dont support subversive, treasonous, traitorous senator david vitter at all -- however, having said that we have to give him credit for being pretty darn clever in getting his propaganda out.

this evening at 4:11 p.m., cst, we received a telephone call and on the caller id it read "tele town hall 253-236-2011." we thought that it was some sort of robo-call similar to what we've posted before. so we switched on the recorder and got jumped in to some sort of live telephonic town hall meeting.

unfortunately, around 30 minutes in, the call for whatever reason disconnected.

that's too bad because our question to the senator had to do with the federal reserve. if we had the opportunity to have asked, it would have went something like this:

hello senator vitter -- as you know the federal reserve was created by the unconstitutional federal reserve act of 1913 and furthermore the federal reserve is not a federal agency -- in fact it is a privately owned central bank which creates federal reserve notes out of nothing, backed by nothing and at interest.

this was all proven as far back as the 1950's due to the painstaking research by eustace mullins in his book 'the secrets of the federal reserve.'

so my question is -- would you lead the way and/or support an effort to repeal the federal reserve act of 1913 - if so why and if not why?

UPDATE wednesday 19 october 2011: we noticed that chad over at the dead pelican mysteriously removed his web page. the page is reproduced below from its google cache:

SLEAZE MAIL: CANDIDATE ATTACKS RIVAL ON AGE, NUMBER OF KIDS, AND LIVING WITH HIS MOTHER

October 16, 2011--3:00 AM CDT

A direct mail piece is creating quite a stir in the hotly contested race for district 103! Ray Garofalo has been endorsed by U.S. Senator David Vitter, and is known for his ties to the video poker industry.

He is also responsible for the controversial piece in which he calls Bayham a "37-year-old with no wife, no kids, who lives with his mother."

Is he comparing the candidates' positions on tax policy? Education policy? Gaming? Any issue of substance?

NO!

Garafolo seems to think that age, number of kids, and a wedding band are what really matter to the people of district 103!

Click here for large version of mail piece.

We are told that even Garofalo's own wife has chided him for the piece.

la house district #103 ray garofalo vitter endorsed sleaze mail.

this race is likely a toss-up as to which candidate would be the worst. time and a voting record will tell.

mr. bayham has a lot higher name recognition his work being picked up and mentioned online a lot.

at first we thought that we had mr. bayham confused with another blogger but it turns out that he does write the the sports blog we were thinking of.

we'd have to agree with mr. bayham's response and add that if the garofalo campaign cant easily and articulately present some rino traits to mr. bayham's platform to the voters or doesnt care to instead choosing this -- then how can their constituents really rely on their being smart enough to read house and senate bills to figure out what they really mean?

ksyl caller becky: david vitter a cosponsor of S.510 fed/homeland security takeover of food supply

while we're unsure about all of the other stuff that frequent ksyl talk radio caller "becky" was on about, this is the first time that we've heard it mentioned in the msm that senator david vitter is a cosponsor of S.510 fda food safety modernization act -- so we give her props for that.

we wont hold our breath, but perhaps now someone will question senator vitter -- who, of course, claims to be a conservative republican -- just how he can justify cosponsoring and supporting such a massive expansion of federal authority and expenditure and still claim to be a conservative or even a republican. we're sure others would like to know the chapter and verse from the republican party platform that senator vitter is using as justification.

Senate Bill 510 vote delayed until after Thanksgiving - Take action now to oppose food tyranny

(NaturalNews) If there's one thing to give thanks for this year, it's the fact that the Senate floor vote on the so-called "Food Safety Modernization Act" has been delayed until after the Senate's Thanksgiving recess.

This gives all of us -- the commonsense opponents of S.510 who don't want the FDA having authority over raw milk, seeds and backyard gardens -- another week to flood the offices of U.S. Senators with calls, faxes and emails that express opposition to the bill.

The jury is still out on the Tester-Hagan Amendment which would exempt small farmers from some of the more tyrannical requirements under the law.

If this amendment were adopted, it would substantially improve the bill, but even with this amendment, the bill is just another overreaching expansion of Big Government into yet another area of incompetence. (If the government can't run health care worth a darn, how are they supposed to manage the entire food supply?)

The 1099 paperwork amendment
As part of this debate over the safety of the food supply, Sen Mike Johanns is making a courageous attempt to kill the new, idiotic 1099 reporting requirement that would require every person running a small business in America to get 1099 forms from Best Buy, Wal-Mart, Costco, Amazon.com or any other retailer where they've spent over $600 in the previous year.

This absolute nightmare of 1099 paperwork was passed as part of the Obamacare health care reform legislation earlier this year.

It will turn America's small business owners into paperwork pack rats and criminalize anyone who doesn't spent several hundred hours a year chasing 1099 forms from corporations that are almost certain to refuse to give them to you.

This is the government's way of penalizing small business owners in America and killing off yet more jobs as a way to destroy the economy.

This 1099 recall is the only real positive thing being considered in the Food Safety and Modernization Act. And as you've probably noticed, it has nothing to do with food.

What comes next for S.510
On Monday, November 29, a vote will be taken on the Harkin amendment, which is merely a rephrasing of the bill with some new wording that came out of committee.

After that, a vote is planned for the bill itself, meaning S.510 could be passed into law on November 29th.

Additional debate time might be invoked for various amendments to the bill, as there are some motions still pending (Johanns, Baucus, Coburn). So it's not a given thing that a final vote will happen on Nov 29th.

Watch NaturalNews.com for more updates on this bill throughout next week. We will continue to rally opposition to the bill.

I'm not against some commonsense improvements in food safety, but to give Big Brother yet more control over seed saving, backyard food production and small organic farms is an outright disaster, not an improvement.

Besides, as we now know, the problem with e.coli, salmonella and other pathogens in the food supply is really a problem with factory animal farms -- notably cattle and chicken operations.

That's where these pathogens come from (e.coli grows in the intestines of animals), so cleaning up factory animal farms is the answer to food safety, not invoking the FDA and its food irradiation agenda.

Why not hand the FDA more power over our food supply?
It's amazing to see that people are lining up to grant more power to the FDA -- the very agency that has killed more Americans through its corruption, fraud and negligence than any other organization in the history of the nation.

I've written a full story on this important fact, which details how the FDA is far more dangerous than terrorists and that putting the FDA in charge of our national food supply can only lead to disaster. Read that story.

Take action now to stop S.510
Your voice needs to be heard on this issue. The vote on this bill has been delayed until after the Thanksgiving recess, so you have more time to oppose this dangerous legislation.

S.510 fda food safety modernization act federalizes and places food production under homeland security

"even if the intent is not explicitly stated as control over all farms -- that is -- what is -- this legislation and they can use that to impose their world view on everyone."

~ liz reitzig, secretary, national independent consumers and farmer's association.

(NaturalNews) Senate Bill S 510 Food Safety Modernization Act vote imminent: Would outlaw gardening and saving seeds

Senate Bill 510, the Food Safety Modernization Act, has been called "the most dangerous bill in the history of the United States of America."

It would grant the U.S. government new authority over the public's right to grow, trade and transport any foods.

This would give Big brother the power to regulate the tomato plants in your backyard.

It would grant them the power to arrest and imprison people selling cucumbers at farmer's markets.

It would criminalize the transporting of organic produce if you don't comply with the authoritarian rules of the federal government.

"It will become the most offensive authority against the cultivation, trade and consumption of food and agricultural products of one's choice.

It will be unconstitutional and contrary to natural law or, if you like, the will of God." - Dr. Shiv Chopra, Canada Health whistleblower

This tyrannical law puts all food production (yes, even food produced in your own garden) under the authority of the Department of Homeland Security.

Yep -- the very same people running the TSA and its naked body scanner / passenger groping programs.

This law would also give the U.S. government the power to arrest any backyard food producer as a felon (a "smuggler") for merely growing lettuce and selling it at a local farmer's market.

It also sells out U.S. sovereignty over our own food supply by ceding to the authority of both the World Trade Organization (WTO) and Codex Alimentarius.

It would criminalize seed saving, turning backyard gardeners who save heirloom seeds into common criminals.

This is obviously designed to give corporations like Monsanto a monopoly over seeds.

It would create an unreasonable paperwork burden that would put small food producers out of business, resulting in more power over the food supply shifting to large multinational corporations.

I encourage you to read more about this dangerous bill at the Food Freedom blog.

Watch this excellent video on NaturalNews.TV which explains S.510 in more detail:

In addition, the Cornucopia Institute recently sent out an urgent call-to-action email containing the following information:

How to protest Senate Bill 510

1) Go to Congress.org and type in your zip code in the box in the upper right hand corner.

2) Click on your Senator's name, and then on the contact tab for their phone number.

You can also call the Capitol Switchboard and ask to be directly connected to your Senator's office:

202-224-3121.

3) Once connected ask to speak to the legislative staff person responsible for agriculture. If they are unavailable leave a voice mail message. Be sure to include your name and phone number.

Give them this message in support of the "Tester Amendment" which would exempt small farms from S.510:
"I am a constituent of Senator___________. I ask that he/she support the Tester Amendment to the food safety bill.

The Tester Amendment will exempt the safest, small, owner-operator farms and food facilities and farmers who direct market their products to consumers, stores or restaurants.

Food safety legislation should not create inappropriate and costly regulatory barriers to family farms and the growing healthy food movement in the drive to crack down on corporate bad actors.

Please support the Tester Amendment and market opportunities for small and mid-sized family farms, and small food processing facilities."
You may also wish to explain that you oppose the Food Safety Modernization Act in its entirety, and it is a destructive, freedom-crushing law that will destroy the future of food in America.

Remember, America has already lost control over its money supply to the Federal Reserve (nearly a hundred years ago);

America has lost its health due to the medical industry and its profit-from-sickness agenda.

Now we may lose our right to grow our own food and save our own seeds if Senate Bill 510 passes.

This is a dangerous, tyrannical law that would thrust the American people into an age of darkness and malnutrition.

It would criminalize many of the very people growing our food and turn food production into yet another corporate monopoly.

Please take the time right now to contact your U.S. Senator and voice your strong opposition to this bill.
S.510 is sponsored by senator richard durbin and some twenty co-sponsors including senator david vitter -- who became a cosponsor on 27 may 2010.
====
we phoned senator david vitter's washington, d.c. office this morning. surprisingly (or not) he is a cosponsor of S.510.

we were unable to speak to his "legislative staff person responsible for agriculture," as the staffer who answered the phone said that he was in a meeting.

we asked him to tell senator vitter, that although we know that he is a cosponsor -- to vote against S.510 or alternatively to vote for the "tester amendment."

next we phoned senator katrina mary landrieu snellings washington, d.c.office. we were put in contact with olivia phillipe (phonetic), when we asked to speak to the agricultural staff person.

we requested that she tell katrina mary to vote against S.510 or alternatively, vote for the "tester amendment."

"the tester amendment"

we were looking around but couldnt find a copy or the text of the amendment. so we phoned senator jon tester's washington, d.c. office and spoke to very friendly staffer's who said that in basic, it exempted farmers and farms making $500,000 or less. senator tester's office promised to email or send a copy of the text before long.

meanwhile, the senate voted to agree to invoke cloture to proceed to S.510:

blogger to candidates: address louisiana judicial corruption & stop insulting our intelligence

By Law and Grace, Inc.:

RE: David Vitter ad slammed as racist by advocates for immigrants
By: Jonathan Tilove
Times-Picayune @ nola.com
If David Vitter's campaign ads would more closely address and resemble the issues facing Louisiana, he would fare a whole lot better!

We have SO MANY Louisiana problems which need addressing, Vitter could help undecided voters --including me, to better ascertain what he intends to do about them!

Whether or not David Vitter dislikes people based upon the color of their skin, his pattern of operation demonstrates that he favors the ELITE class of people --to the unfair and unjust disadvantage of others (probably including immigrants, and not all Blacks --as I feel sure he has his 'tokens').

His pattern of conduct indicates that he thinks he has superior thinking skills to his audience by showing TV ads that talk about what Charle Melancon did or did not do for or with President Obama.

I don't give a flip about hearing Vitter's SAME STUPID OKEY DOKEY talk.

I PREFER to know which of the ISSUES & CONDITIONS affecting every day / non-elite people Vitter intends to address!

I have a grasp on what he does to make things better for the rich and powerful, but they are not the only residents of Louisiana --and many of them are getting old, and some are or will be indicted.

It is aggravating to hear Vitter on the television, Melancon, and others --but especially Vitter because he does it ALL THE TIME, continuing to talk about what is least significant in these crucial economic times!

I could have better respect for Vitter if he had better respect for his listening audience and talked about the issues of Louisiana which desperately need answers since not everyone is interested in pleasuring him or her self, or going hunting, and other gratifying things while being worried about economic conditions.

I AM FAIRLY CERTAIN that I never hear Vitter say anything those things because he does not intend to do anything.

I don't know if I want to vote for Melancon, but the jejune finger pointing at Melancon rather than concrete discussion of the issues wastes my time!

I am trying to give Vitter the benefit of the doubt since I against any politician who engineers judicial benches to be filled with inept and corrupt State as well as Federal judges; and who underhandedly influences appointments of U.S. attorneys!!!

I am further against politicians who pleasure themselves with travel and life's finest while their fellow-citizens endure constant ravages of crime and corruption, with no end in sight; and while their cronies receive slaps on their wrists when their acts of corruption can no longer be whitewashed.

Those are some of the issues for which Louisiana has needed answers for a very long time!

I reiterate my assertion that nearly every social problem in Louisiana can be linked to when controversies require judicial remedies and no other choice except face judges --whom, being friends and giving the best gifts or doing favors for judges ensures good outcomes.

And although there are many intelligent attorneys here, it does not require intelligence nor knowledge of the law, nor even submitting lawful grounds to become granted favorable rulings by certain judges, say for example, Ivan Lemelle and Kurt Engelhardt.

Now, since there seems to be changes in the way comments become posted here at nola.com (particularly for Vitter and his worshipers) here is what I'm posting throughout the Internet:
------------------------------------------------------------------------------
Now is a good time for election candidates to be talking about solutions for the LOUISIANA CORRUPTION TITANIC rather than each other.

What REALLY is wrong with Louisiana is inept and / or corrupt judicial and U.S. Attorney in positions, that were mainly orchestrated by political placement power!

The justices’ abuses are EASILY PROVABLE by looking at Louisiana real estate / mortgage illegalities, and facilitating court judges.

Thankfully, FORECLOSURE FRAUD has center stage in the national media.

The light will shine brighter in this judicial corruption that has been hiding in plain sight here in Louisiana –and directly linked to Louisiana’ blighted communities \ commercial and residential frauds \ insultingly blatant Bankruptcy lawlessness \ illegal evictions \ unjust homelessness \ disintegrated households \ poverty \ violence \ joblessness \ substance abuse, etc. (Of course, I have approached lawmakers –to no avail– with suggestions, only to incur severe reprisals. And, an option does not exist for me to retreat from doing what I believe is right, nor moving away from loved ones.

Presently –from Judge Thomas Porteous’ impeachment trial, testimonies about the “Louisiana Way” of giving gifts (bribes) and doing ‘favors’ for judges– members of Congress have more than ample information which makes it silly to impeach Porteous and disregard Louisiana in-your-face lawlessness.

Foreclosure fraud has now been explained so clearly, even a child can understand that some people have indeed been illegally tossed from their homes, it will not be hard to detect the unlawful foreclosures that occurred here –especially the illegal foreclosure that unjustly caused people to be Hurricane Katrina and Hurricane Rita exiled from their homes (but their neighbors erroneously blame them for blight).

In fact, a mere GLANCE at Louisiana fraudulent property transactions surrounding Freddie Mac, Wells Fargo, and certain foreclosure mills here –supplies additional reasons for Capitol Hill to probe Louisiana.

**The current congress members who represent Louisiana have done zilch about decades of PRIMA FACIE foreclosure and mortgage fraud!

To reiterate: David Vitter, Charlie Melancon, and other candidates: You have the opportunity to show worthiness of people’s votes by not insulting our intelligence with finger-pointing at each other, but by talking about your plans for addressing the LOUISIANA CORRUPTION TITANIC; it seems headed underwater with all of us on board.

FLASHBACK: chet traylor honored by joint session of loony looziana legislature

immediately following louisiana supreme court chief justice, catherine d. kimball's 28 april 2009, address to the states finest collection of freaks, perverts and criminals masquerading as the joint session of the louisiana legislature, about -- of all things "the state of the judiciary," retiring associate justice, chet traylor was personally recognized by them for honor.

we watched the whole thing live ... if only we knew then what's been reported lately. we would have loved to have been a fly-on-the-wall. our eyes would have been fixed on state representative noble ellington and his posse. what was he thinking? what was he saying during all this?

part of their suspension of the rules was to waive calling the roll, so we dont know for sure that he was even present.

chet traylor went ahead and retired from the supreme court and resurfaced earlier this month when he "unexpectedly" qualified to run against the incumbent david vitter for the republican party senatorial nomination in next month's primary.

mr. traylor is said to be the same politically with senator vitter which means that he is a totally safe candidate. we can expect traylor, if elected, to carry on supporting unconstitutional, laws as well as the illegal and immoral wars america finds itself in today -- just like treasonous, traitorous rat and subversive rhodes scholar david vitter. we can also expect mr. traylor if elected to support sending american kids to die for israel in iran.
    .
mr. traylor's supposed calling card was that he was the hi-moral choice. except that not long after he qualified the gannett/monroe news star printed a report u.s. senate candidate chet traylor says he's done nothing unethical in his personal conduct.

    ====
    ====
from this we learn that mr. traylor has been accused of having affairs with two married women. one of the women was the wife of current state representative noble ellington. the other one is his step-daughter-in-law.

you'll just have to read the story or google it.

    no honor among thieves
the thing is that all those freaks, perverts and criminals sitting in the house chamber that april day - they all knew all this was going on. yet not one spoke out to say 'hey this isnt right, traylor was messing with our colleagues wife (or family) we shouldnt be honoring him.'

mr. cain's entrance into the race is likely designed to draw some of the evangelical vote away from the incumbent david vitter but why anyone would vote for this silly clown and rino is a mystery -- the same goes for vitter.

tell senator vitter (a member of the subversive rhodes scholars) that the best way to begin to restore america economically is to stop being a treasonous, traitorous, war mongering rat and put america first.

tell senator vitter to stop being israel's bitch. NO MORE WARS FOR ISRAEL! stay out of iran's affairs and bring our troops home from iraq, afghanistan and everywhere else around the world that they are stationed.

shock: hate crimes charges made against blacks!

    excerpt:

BAKER, LA (WAFB) - An alleged hate crime has some parents in an uproar. Five black Baker teenagers were charged with felonies after a vicious fight broke out at a local park.

shoe on the other foot: "i'am really hurting you know, i'am really scared because they charged these kids with these crimes that you would have to actually look over your back for." katrina franklin whose two daughters were among the teens arrested
"One of them referred to one of the children as a beaner," said Lt. James Broussard with the Baker Police department. He says that statement set off a series of events that lead to a knock-down, drag-out fight. ~ read more [video].

wafb just gives the names and not the exact statutes that the five were cited for violating so we had to search around and try to find them. by the way, babcock law firm has a copy of the louisiana revised statutes that often comes up at the top of searches making it a lot easier to find the actual statute on legis.state.la.us.

anyway, the two 17 year olds are broderick ford and trenisha franklin charged with felony second-degree battery, hate crime, disturbing the peace and contributing to the delinquency of juveniles.

while the three juveniles were also booked on hate crime, disturbing the peace and second degree battery.

according to the human rights campaign: louisiana's hate crime law is at R.S. 14:107.2. it came into being by ACT 1479 passed by the 1997 regular legislative session.

from whatever of this mess we can tell, for hate crime liability to attach its presumed that the violator firstly violated one of these so called underlying offense(s):
first or second degree murder; manslaughter; battery; aggravated battery; second degree battery; aggravated assault with a firearm; terrorizing; mingling harmful substances; simple, forcible, or aggravated rape; sexual battery, second degree sexual battery; oral sexual battery; carnal knowledge of a juvenile; indecent behavior with juveniles; molestation of a juvenile; simple, second degree, or aggravated kidnapping; simple or aggravated arson; placing combustible materials; communicating of false information of planned arson; simple or aggravated criminal damage to property; contamination of water supplies; simple or aggravated burglary; criminal trespass; simple, first degree, or armed robbery; purse snatching; extortion; theft; desecration of graves; institutional vandalism; or assault by drive-by shooting. ~ subsection a
it says that if the underlying offense is a misdemeanor you may be fined not more than five hundred dollars or imprisoned for not more than six months, or both.

if the underlying offense is a felony then the convict may be fined not more than five thousand dollars or imprisoned with or without hard labor for not more than five years, or both. these are in addition to the penalty for the underlying offense. but

a conviction under either the misdemeanor or felony underlying offense calls for the hate crime sentence to run consecutively to the sentence for the underlying offense.

if wafb is correct then in this case the presumptive underlying offense for all five would be second degree battery, R.S. 14:34.1 a felony see R.S. 14:2. disturbing the peace and contributing to the delinquency of juveniles are not hate crimes "underlying offenses."

somehow the underlying offense to which hate crime liability mysteriously attaches is in your selecting your victim because of actual or perceived race, age, gender, religion, color, creed, disability, sexual orientation, national origin, or ancestry of that person or the owner or occupant of that property or because of actual or perceived membership or service in, or employment with, an organization: and then as you saw above goes on to list just about every crime in the book. ~ subsection a

this law doesnt make any sense because 14:107.2B and C begins by stating: "if the underlying offense named in subsection a..." but subsection a doesnt distinguish that long list of crimes as being underlying offenses. it begins:"it shall be unlawful for any person to select the victim of the following offenses..." also nowhere in the law is it spelled out when, why or how these offenses become underlying offenses.

this law must be unconstitutionally vague as hell. even the criminal and civil federal rico statute requires showing from another shopping list of "underlying offenses," or predicate offenses to choose from -- how they work together (the enterprise) in order to kick in a rico charge.

we wanted to see how the state supremes reasoned their way through an opinion dealing with hate crimes law. so, we did a simple search of the state supreme court website for R.S.14:107.2 - the hate crime law.

we were much surprised when that search only returned two instances of it being cited. the opinion and the dissent from: state of louisiana v patrick palermo consolidated with his brother frank palermo's case.
    decided on 31 may 2002.

the two brothers had been convicted under R.S. 14:54, placing combustible materials, also a hate crime underlying offense.

frank palermo had also been convicted of violating the hate crime law. his brother patrick was charged as well but was found not guilty of that, but guilty of violating R.S. 14:54..

one way or another, the supreme court declared R.S. 14:54 to be unconstitutional so the palermo brothers conviction including frank's hate crime conviction and sentence was vacated and set aside. the supremes didnt address the hate crime law -- noting at the bottom of a page that consideration of it wasnt before them.

associate justice bernette j johnson wrote a pretty tersely worded dissent complaining that the court missed its first opportunity to affirm the hate crimes statute. but we wonder what sister girl would say now that all these blacks got charged with these hate crimes?

who knows, maybe with this case justice johnson will get her wish. if the baker police department and the prosecutors office stick to their guns and hopefully the defendants will get help from some brilliant, hardworking criminal defense attorneys this law could possibly get struck down. good.

we're only saying that the hate crime law should be struck down. not that the accused should totally get off should they be found guilty of violating one of the legitimate charges.

a search of the third circuit court of appeal website doesnt return any hate crime references.

ACT 1479 started out as SB 914 by senators cox and johnson and representative murray. it passed the senate without nary a nay vote. in the house it was 61 yeas to 37 nays. randy wiggins voted no and we certainly thank him for that nay. on the other hand, david vitter, rodney alexander, charlie dewitt, israel "bo" curtis and dianne winston are the names of some who voted for hate crimes.

it probably should be noted that in the senate old fake preacher b.g. dyess voted for it twice. on final passage and to concur.

R.S. 1407.2 has been amended twice since 1997. by ACT 301 of the 2001 regular legislative session through HB 604 by representative devillier which repealed aggravated oral sexual battery in order to revise it into oral sexual battery. R.S. 14:41.

then again in the 2004 regular legislative session by ACT 676 senator ullo's SB 659 where the lege changed the name of the offense of aggravated sexual battery to second degree sexual battery. R.S. 14:43.2.

this is just more useless law. as you can see from just the list of hate crimes "underlying offenses" there are already plenty of laws to punish offenses against A HUMAN BEING.

la gop chairman roger villere is a hypocrite and a fraud

as everyone knows, yesterday the u.s. house of representatives voted 240 - 179 to "disapprove" of congressman joe wilson's "you lie" outburst at president obama during the president's 09 september 2009 address on health care to the joint session of congress.

not long after the vote, louisiana gop chairman roger villere issued a statement which was picked up and heavily promoted by the dead pelican. ~ link or screen grab, in which villere takes congressman charlie melancon (d) to task for voting for the rebuke.

congressman melancon is also an announced candidate in next years senatorial election against david vitter.

however, a closer look at house roll call vote #699 reveals that congressman melancon was not the only representative from louisiana who voted for the rebuke. the other vote was by flaky nola rino anh cao -- yet there is no word or mention of this by villere.

this failure on villere's part to rebuke louisiana rino's for their behavior is part and parcel of villere's incompetent (read criminal) management of the louisiana republican party.

when are louisiana republicans ever going to get a clue and clean up and run off the criminals like villere who himself is a rino who are running their party into the ground? why cant they see that villere and company are working a plan to destroy the la gop?

why wont louisiana republicans demand honest, respectable leaders as well as political candidates and elected officials?

will another louisiana rino freak charles boustany crash-n-burn delivering the republican response to president obama's speech?

congressman john fleming (also a medical doctor) would seem like the logical choice to deliver the response.

why the republican leadership would choose charles boustany who already has a voting record proving that he is a rino and a fraud sure as heck doesnt help their position any.
