all we had to read was this first "whereas" in the recitals to see how this scam operates. do you see the deception? redflex has EXCLUSIVE "knowlege." this means that the city wont even know what information and databases redflex is compiling on you, who or what they are sharing or selling the information to and you wont be able to find out from the city under a public records request either.

a shocking comment made by the city attorney mr. johnson was when he said that "as soon as redflex can get all that to me (the above mentioned information) i intended to present it to the council IN EXECUTIVE SESSION." now this statement should immediately send up red flags! the first thing you have to ask yourself is why is the city being so secretive? what is the city hiding and what is it about redflex and this spy camera scam that the city doesnt want you to know?

RS 42:6.1 is the statute that governs the exceptions to open meetings. the only possible provision that might apply is 42:6.1A(3) which states: Discussion regarding the report, development, or course of action regarding security personnel, plans, or devices. how could this possibly apply? after all, they're just talking about simple red-light cameras right? you run a red-light and get your picture taken and a citation in the mail right? we're not talking about security protocols for a presidential visit or security measures for the d.g. hunter power plant. or is there a lot more to all this, that the city isnt telling you about and that the city doesnt want you to know? we think its a lot more to it than what the city would have us believe.

you dont have to possess a degree in psychology to figure out that this is all about making money. one clear example is the statements made by councilman louis marshall. you can almost see the dollar signs in his eyes when he goes on about "the reason why i ax'd that this be put in the committee, while i was down in new orleans...listening to the television there...jefferson parish had if iam not mistaken 16,000 tickets paid, only two were contested...this could be something that could be another revenue source for the city." so there ya have it! just like we've maintained all along its about the money. after councilman marshall made the above statement and after a period of time elapsed he must have thought that he should add this bit in just to cover himself "and at the same time you could be making a lot safer for the city..." mmhmm.. now if councilman marshall would have been thinking foremost about safety that would have been what he mentioned first instead of as an afterthought -- because safety, it is an afterthought.

speaking of the mayor (and if this guy ever leaves politics he should really go to hollywood and pursue a career in the movies coz hes quite an actor) gave his obligatory spiel against cameras. this was so reminiscent of his little speech he gave against the baggy pants ordinance which you might remember he allowed to become law anyway knowing full well that its wrong.

KNOXVILLE, Tenn. - Police have lost red-light cameras to traffic accidents but never to gun play. "This is the first one that's been shot," Capt. Gordon Catlett said of the wounded camera at the intersection of Broadway Avenue and Interstate 640 — one of 15 camera-equipped intersections in the city.

Clifford E. Clark, 47, was charged with felony vandalism and reckless endangerment for allegedly firing at least three rounds from a .30-06 hunting rifle at the camera, knocking it out of action.

He was arrested after patrol officers heard shots around 2 a.m. Sunday, spotted a minivan leaving the parking lot of a closed business and pulled it over. Inside they found Clark and the high-powered rifle.

Clark, now facing a $50 fine if convicted and loss of his rifle, refused to say anything about the incident to police, leaving the motive unclear.

Catlett, who oversees the red-light camera program, said 6,798 drivers have been photographed running the red light at Broadway and I-640 and ticketed since the camera was installed in 2006. Clark was not one of them, he said.

rep. herbert dixon: church brothers were angry with him over his HB 94 gas tax increase bill

on 20 may 2009, the house transportation, highways, & public works committee met to hear gonzales, louisiana rethuglican, eddie lambert's HB 254 a very unrepublican bill to authorize the use of automated traffic photo enforcement systems (redlight cameras) state wide.

rep. herbert dixon recounted his own experience with his very unpopular HB 94 a bill to raise the state gasoline tax and how at church one day, his church brothers at the nazarene missionary baptist church, alexandria, la., confronted him about it, using "terminology" that according to mr. dixon was "very unbecoming of a christian."

"terminology unbecoming of a christian" is subjective. for all we know in rep. dixon's mind any criticism of him is "unchristian" whether it's justified or not. we say that their standing up and speaking out against bad legislation and bad legislators is exactly what christian church members are supposed to be doing and have a duty to do and we salute them for it.

we would also ask the good members of the nazarene missionary baptist church to get on rep. dixon again and criticize him for his vote for HB 687 which will ban in school dentistry which will unnecessarily harm many, many of louisiana's poor children.

rep. dixon voted for this evil bill but will have another chance the week of 26 may 2009. this time we hope that he votes properly and votes against HB 687.

this is a copy of the petition the australian company redflex filed against the louisiana state board of private investigator examiners to keep them from hearing a complaint concerning whether or not redflex is in violation of louisiana state law. this is charles l. patin jr. with the kean miller law firm. they represent redflex. mr. patin and kean miller earn their thirty pieces of silver by representing foreign interests against the interests of louisiana citizens and are seeking to weaken louisiana laws and our state constitution. mr. patin and kean miller ought to get honest, respectable jobs.

motion for summary judgment filed by david a. young, esq. with the louisiana attorney generals' office on behalf of the louisiana state board of private investigator examiners.

mr. young repeatedly shows how redflex uses a "'red herring,' [in] an attempt to mislead the court..." and attempts to twist louisiana state law and common sense.

mr. young writes:

"despite...the fact that redflex qualifies as a 'person' under la. rev. stat. 37:3503(6) because it is a corporation, redflex then asserts that the boards jurisdiction does not extend over it because its operations involve 'automated equipment' which does not include the interaction of a person to detect and videotape speeders and red light runners.

in the alternative, redflex asserts its own employees are exempt from the jurisdiction of the board pursuant to the contractual agreement [click here to download 31 page .pdf 7.4mb] redflex has with lcg [lafayette consolidate government]. redflex asserts that its own employees are not its employees under the specific auspices of its contract with the lgc. instead, redflex asserts that because lcg's "degree of control" over redflex's activities is so pervasive, the contract is somehow transformed from a service contract to an employment contract. and as a result individuals who would otherwise be employed by redflex mutate into lcg employees."

then, mr. young shows how in the contract between lafayette consolidated government and redflex it states:

"9.2 relationship between redflex and lcg. nothing in this agreement shall create, or be deemed to create, a partnership, joint venture or the relationship of principal and agent or employer and employee between the parties. redflex is and shall be an independent contractor of lcg and nothing contained in this agreement will create the relationship of principal and agent or otherwise permit either party to incur any debts or liabilities or obligations on behalf of the other party (except as specifically provided herein)."

mr. young continues: "so while redflex asserts its employees are now employed by lcg, the agreement suggests something completely different"

this is just one example of the scam lafayette and redflex is trying to run on louisianaians.

the hearing is set for 11 february 2008.

Louisiana state law does not allow the use of cameras to issue traffic tickets, so the ticketing process was altered. The violator will receive a civil ticket instead of a traffic ticket, which means lower fines for violators.

"It will be less than a regular ticket," said Ingolf Partenheimer, chief traffic director of Baton Rouge Public Works. "The ticket will be in the $75 range. The intent is to make people aware and stop people from running the lights."

But because there are no laws in place to enforce the payment of civil tickets in Louisiana, such as warrants, suspension of license or even due process, violators will not be forced to pay.

"We are hoping legislation in the future will be able to force people to pay," said Art Boudreaux, Baton Rouge city prosecutor. "It's all uncharted waters for us."

In Houston - where traffic laws resemble those of Baton Rouge - traffic cameras were implemented over six months ago, but residents are not paying their fines. Houston traffic lawyer Scott Markowitz and colleagues are challenging the constitutionality of the cameras, and the city, is losing anticipated revenue. Markowitz said he thinks the cameras are money making tools for the city and the city council's interest is in new revenue, not accident reports.

"There was very little outcry [by Houston residents]," Markowitz said. "People were not paying them. They can't issue a warrant. If you don't pay, nothing happens. Behavior patterns are not changing. It's a money grab. The city council isn't asking about accident reports. They want to know why violators aren't paying their fines."

the bit about "there are no laws in place to enforce the payment of civil tickets" doesnt appear to be entirely accurate. an lsu law school graduate tells us because you can always file a civil suit to get a judgment. although using the taxpayers money associated with the cost to file and litigate a civil suit to recover a $75.00 fine doesnt make economic sense or most importantly to the politicians -- political sense.

lafayette city-parish president joey durel appears to be a silly buffoon who plays at being a republican when its politically expedient for him to do so. mr. durel says that talk about the united states constitution is "smoke and mirrors." doesnt it make sense that if the alexandria police department is too incompetent to enforce something as mundane as traffic laws in a city of some 45,000 people that the common sense thing to do would be to get rid of the chief of police and the upper police force management and put in place management that could properly motivate, supervise, train and inspire the rank and file policemen to do their jobs?

it doesnt make any sense whatsoever to hire an alien company headquarted half the world away to enforce local laws. on top of that you dont have any idea where the information they are recording is going or to who or what its being shared or sold. for all we know they could be taking pictures of every automobile that goes through the intersections to build profiles and databases with.

the newspaper.com has an article about the recent united states supreme court decision in melendez-diaz v. massachusetts. the the case turns on the constitutional right to confront your accuser in court.

Red light camera and speed camera manufacturers fear that last month's US Supreme Court ruling in the case Melendez-Diaz v. Massachusetts could create legal turmoil for the industry.

The National Campaign to Stop Red Light Running issued a statement yesterday warning that the ruling has armed motorists with a greater ability to challenge the basis of automated traffic citations.

Speed cameras, for example, depend heavily on legal faith in a certificate that claims to confirm the total reliability of a machine's speed reading. In the Melendez-Diaz case, the high court ruled that merely producing such a certificate in court is insufficient.

Defendants have the right to cross-examine any individual who claims to have certified evidence.

US Supreme Court Upsets Speed Camera Industry

in a 20 november 2007 alexandria, la. city council committee meeting, alexandria city attorney charles "chuck" johnson, esq. said that he planned to secretly present more redflex scam information to the city council out of the public view in a special secret meeting (called an executive session) on 04 december 2007.

the city has posted the agenda (see link or here) and redflex doesnt appear to be anywhere on the agenda.

of coz the agenda ends with that pesky line: "D. ANY OTHER BUSINESS WHICH BY UNANIMOUS CONSENT MAY PROPERLY COME BEFORE THE COUNCIL." so this could theoretically allow the city council to sneak in a secret discussion on redflex.

however, the specific law the city cites for going into executive session La. R.S. 42:6.1(A)(2)

Strategy sessions or negotiations with respect to collective bargaining, prospective litigation after formal written demand, or litigation when an open meeting would have a detrimental effect on the bargaining or litigating position of the public body.
