getting railroaded louisiana style: state of louisiana v leslie otto ordodi
pre-crimes & thought crimes now prosecutable in louisiana!
only one small problem though -- mr. ordodi never robbed a bank. mr. ordodi never pulled a gun, never passed a demand note, never asked for or demanded money from any bank clerk or teller. in fact all mr. ordodi was doing was in the opinion of a new iberia, louisiana, regions bank employee acting suspiciously. nevertheless, this didnt stop assistant district attorney jeffrey j. trosclaire from charging mr. ordodi with violating la r.s. 14:64 and la r.s. 14:27. the third circuit, for once, [actually twice], did the right thing and reversed mr. ordodi's conviction. not to be outdone the apparently mean spirited assistant district attorney trosclaire appealed to the state supreme court.
now we ask you what possible good could it serve putting mr. ordodi in prison at hard labor for three years? he didnt even commit a crime. isnt the point of incarcerating someone to punish them and also to rehabilitate them? dont you think that the experience of being arrested and having his name splashed all over the media was enough to "condition" mr. ordodi not to do something like that again? why are we taxpayers being forced to pay to incarcerate this person?
another question that comes to our mind is who decides how long someone should serve in prison for a crime committed? in other words how do "they" arrive at a figure of three years at hard labor is a fitting sentence for attempted armed robbery? do they consult with mental health professionals to arrive at this figure? or do they just pick a number from thin air? they pick a number from thin air is more likely.
so now you can be going about your daily business and in the opinion of someone else be deemed to be acting suspiciously and be charged with a crime that you might have been thinking about committing.
there was no need to lock mr. ordodi up for three years for something he didnt even do. now these five bastards JUSTICE JEFFREY P. VICTORY; JUSTICE JEANNETTE THERIOT KNOLL; JUSTICE CHET D. TRAYLOR; JUSTICE JOHN L. WEIMER; JUSTICE BERNETTE JOSHUA JOHNSON and thats what they are is a bunch of bastards theres nothing honorable or anything justice about them, have handed sweeping powers to louisiana's districts attorney. think of how the defense attorneys will get richer with all these new cases but then again isnt that what the law is all about -- curtailing freedoms and enriching lawyers? we certainly hope that the voters in these alledged "justices" districts remember them at election time.

NEW ORLEANS (AP) — If you prepare for a holdup and walk up to a teller with a gun in your pocket, you can be convicted of attempted armed robbery even if you never ask for a penny, the Louisiana Supreme Court ruled Wednesday.
It reinstated the conviction of Leslie Otto Ordodi, who was sentenced to three years at hard labor for attempted armed robbery of two New Iberia banks on May 28, 2004.
An appeal court had overturned his conviction because Ordodi never made any threat or demand.
But the 5-2 majority ruled that there was enough evidence to show that Ordodi was planning to hold up a bank, even if he did not follow through.
He was despondent and had money troubles; went into the banks with a concealed, loaded gun; tried to hide his identity by giving a false name and wearing a baseball cap and sunglasses; took the license plate from his truck and left the engine running, and left each bank after seeing it was crowded, Justice Chet Traylor wrote.
"These circumstances support the jury's determination that the defendant specifically intended to commit armed robbery," he wrote.
Chief Justice Pascal Calogero and Justice Catherine Kimball wrote separate strong dissents.
Nothing that Ordodi did "went beyond mere preparation," Calogero wrote, quoting a state law saying that preparation is not an attempt.
Kimball wrote, "He made no threats toward anyone, he never demanded anything of value from anyone, he did not produce or brandish the gun inside the banks. Defendant never acted in a way suggesting he intended to rob either bank."
She also said that, although the majority speculated that Ordodi left because the banks were crowded, prosecutors did not present any evidence suggesting that he was worried by the number of people or went to the second bank hoping it would be less crowded.

wst pal and local blogger cenlamar takes the alexandria daily town talk to task in his post: the town talk: the trees versus the forest cenlamar makes some good points in his commentary and while we dont necessarily disagree with his premise we merely offer our solution:
according to the jacques roy for mayor campaign website, mr. roy ran on a platform of amongst other things: absolute transparency, accountability and crime. in our opinion what mr. roy should do with regard to the town talk's public records request is to make a good faith effort and allow a town talk editor and reporter to view the report in question at city hall in the presence of mr. roy and the city attorney etc. prior to the meeting there should be an agreement between the town talk and the city in which the town talk promises not to print anything from the report that would be potentially to any defendant's advantage. the town talk should also not be given any copies of the report. if the town talk violates this agreement then mr. roy has the perfect excuse for the remainder of his term not to release anything to the town talk again. if it turned out that the town talk reneged on its word the people would support mr. roy.
the coughlin saunders performing arts center leaks that is already established. what remains to be seen is who's fault is it? it must be either/and/or a combination of architectural and/or construction incompetence. who knows it might have been designed and built this way so that some contractor could come back in a few years and make another fortune "fixing" it. its time for the city of alexandria to come clean and allow third party review of the report. for now, that third party is the town talk.
wst note: according to the witsell evans & rasco website the coughlin saunders performing arts center was in association with a alexandria's ashe broussard weinzettle architects, l.l.pwitsell evans & rascoCity Council OKs actions over leaking arts center, honors Mayor RandolphBuilt for $8.2 million with private and public money, and opened more than two years ago, the arts center started leaking immediately during heavy rain and prompted two leak inspections paid for with city money. The city also pays for maintaining and lighting the arts center.

The latest inspection, performed by leak forensics company Quick & Associates, is not being released to the public or the media despite a request for the report filed months ago by The Town Talk.
Roy, who joined committee members in executive session, said he is siding with City Attorney Kelvin Sanders in the decision to keep the report secret.
"The citizens' right to full knowledge of the public record must be balanced against acting in the citizens' best interest when planning for litigation occurs," Roy said.
Roy said those "with interests adverse" to the city protecting taxpayer money must be prevented from seeing the report now.
Sanders said the "mental impressions" of the leak inspector exempts the report from the state's public records laws.
Ratcliff Construction Co. was the general contractor on the Third Street facility, which was designed by the Little Rock, Ark., architectural firm of Witsell Evans & Rasco.

Some Christian conservative groups say both Wal-Mart and the Republican Party have “forsaken God.” And just as the GOP took a hit in the elections earlier this month, the groups say the retail giant’s lower-than-expected November sales figures are the wages of that sin.
Why are sales below estimates? “It is for the same reason things went south for the Republican Party this past election cycle,” read a statement by the Rev. Flip Benham and Pat McEwan, with Operation Save America and Operation Save Wal-Mart. “Wal-Mart has forsaken God and it has forsaken the people who love Him.”
The groups led protesters on Nov. 24 to picket the “gates of hell” — that is, Wal-Mart stores around the country. They say Wal-Mart, like the GOP, has strayed from its founding principles, set by founder Sam Walton, citing Wal-Mart’s dispensing of “Plan B” contraception and the fact that the retailer is a corporate member of the National Gay & Lesbian Chamber of Commerce.

in the article the writer directly quotes a louisiana sheriff freely admitting to violating the constitution and bragging "...I don't give a damn. I'm going to do it."
why are parts of louisiana being allowed to die? are there no honest people at any lever of power anywhere whatsoever in louisiana? the answer is yes! of course! but it appears that they are impeded by corrupt powers in high places.

Lee who said he doesn't plan to target blacks, but "bad guys," has designated fifteen of the most dangerous neighborhoods in Jefferson, most of which reside on the West Bank, to begin an aggressive program of videotaping groups of young men on street corners to detect drug activity.
The plan according to Lee includes mounting cameras in armored vehicles and patrol cars, as well as positioning them in high-crime areas. The images would go to a master tape, so, Lee said, "we know who's there."
The Sheriff noted that some might consider the actions unconstitutional. He explained, "If the three of us were standing on a street corner, we would be offended if a police car came up and started videotaping us. We would be offended. I don't give a damn. I'm going to do it."
Lee has allocated over $140,000 to purchase the new cameras.
The Sheriff said he would discuss the new policy with the NAACP and the ACLU, but he challenged them, even if it means a protracted court battle. "If I step on somebody's toes," he said, "so be it."
Referring back to last month's accusations that the Sheriff's office was planning on engaging in racial profiling, Lee said, "I'm not backing off in what I'm intending to do in those neighborhoods where I know the violence is. We are going to do some aggressive law enforcement things. I confess to you, that we will go right up to the line, and I don't want to cross the line."

LENA -- More than 1,000 people from all walks of life came Thursday afternoon to pay their last respects to the late Julius Patrick Jr.
Ministers, lawyers, engineers, average citizens and politicians filled the gymnasium at Northwood High School for services honoring Patrick, the Boyce mayor who was killed in an automobile accident Sunday.
Donna Clark of Alexandria, a first cousin of Patrick's widow, Beatrice, said his death was hard to accept.
"He was a very lovely, happy person. He was the kind of person who would help people," Clark said.
District Attorney James "Jam" Downs and Assistant District Attorney Phillip Gremillion recalled that he was a "good" man.
Downs said he served as Boyce city attorney for 15 years before becoming District Attorney, and Gremillion held the city attorney's position several years more.
"He was a nice man. He would come by the (District Attorney's) office from time to time to get advice on something or just to talk," Downs said.
Boyce resident Gerald Shepard recalled how Patrick served as mayor basically his whole life. "He's been my mayor since I was 12 years old," Shepard said.
Patrick, who served as mayor 28 years, helped Shepard in "a lot of situations," he said.
Officials from area city governments, including Alexandria and Pineville council members, attended the funeral.
Police Juror Donald Wilmore, who represents the area including Boyce, said, "He and I worked together on many issues. He was a very intelligent man."
Some people may not have realized that Patrick was principal of Reed Elementary and North Bayou Rapides schools while also serving as mayor, Wilmore said.
"He would finish up at the school and then go do his mayor's duties. It made for a long day," he said.
Six ministers participated in the funeral, and expressions of condolence were delivered by representatives of Gov. Kathleen Blanco's office, National Conference of Black Mayors, Louisiana Chapter of National Conference of Black Mayors and Louisiana Municipal Association.
Burial was in Forest Lawn Cemetery in Pineville.

He was preceded in death by his parents, Julius Patrick Sr. and Ella Belle Wardsworth; Battles; two sisters, Helen S. McGaskey and Georgia Mayberry.
He leaves to cherish his memories: his wife, Beatrice J. Patrick; one son, Ronald K. Patrick (Ann) of Garland, Texas; three daughters, Karen Patrick Jones (Ed) of Shreveport, Louisiana, DiAnthia L. Patrick of Fairfax, Virginia; and Riqui' J. Patrick of Silver Springs, Maryland; two grandchildren, Brennan M. Patrick and Kristen Y. Patrick; one brother, Major Williams of Natchitoches, Louisiana; numerous political and education colleagues; and a host of nieces and nephews, relatives and friends.
Pallbearers will be members of Omega Psi Phi Fraternity and friends.
Viewing will be Thursday, November 30, 2006, from 8 a.m. to 10:30 a.m. at Winnfield Funeral Home, 2033 Third St., Alexandria, Louisiana. Viewing will resume at 11:30 a.m. at Northwood High School and will continue until time of service.

Mercuria J.S. Colomb, 28, of St. Rose was driving a car that turned into an SUV heading east, causing it to cross the Interstate 10 median, sideswipe a westbound oncoming car and then crash head-on into a car driven by Patrick, killing him instantly, police say.
Patrick’s funeral is set for 1 p.m. Thursday at Northwood High School in Lena. The Rev. Joe Green will officiate.
Classes at Northwood will be dismissed at 11:25 a.m., school officials said.
Colomb turned herself into State Police and was booked into the Ascension Parish Detention Center.
She is charged with negligent homicide, negligent injuring and improper lane usage. Smith said Colomb left the crash scene headed east on I-10.
Although State Police had a description of the car and a license plate number, it was difficult to track because the owner’s address was listed at a New Orleans residence which was destroyed by Hurricane Katrina, Smith said.
The driver of the SUV, Alona M. Williams, 20, of Baton Rouge, suffered serious injuries, he said. She was airlifted to a Baton Rouge hospital, Smith said.
The driver of the other car, Scott M. Gilbert, 27, of Houston had minor injuries, but he was not taken to a hospital, Smith said.
Viewing of Patrick will be from 8 to 10:30 a.m. Thursday at Winnfield Funeral Home in Alexandria, and then it will resume at 11:30 a.m. Thursday at Northwood High School and will continue until time of service.
At 2:59 PM, on Sunday, November 26, 2006, State Police Troop A responded to a multiple vehicle crash that resulted in a fatality. The crash occurred on Interstate 10 westbound at milepost 189 in Ascension Parish.
In the crash, a Beige Nissan Maxima, Louisiana license plate number OTE 951, was eastbound in the right lane of travel. The Nissan Maxima made a sudden movement and struck a Toyota 4Runner that was traveling in the eastbound left lane. The collision between the two vehicles forced the 4Runner across the median and into the westbound lanes of travel. Upon entering the westbound lanes of travel, the 4Runner clipped a 2003 Saab (westbound left lane), and crashed head-on into 2000 Mazda Millennium (westbound right lane). The Nissan Maxima left the crash scene traveling eastbound on Interstate 10.
The driver of Mazda Millennium and Mayor of Boyce, LA, Julius Patrick, Jr. (B/M/Age 69), sustained fatal injuries and was pronounced dead at the scene by the Ascension Parish Coroners Office. The driver of the Toyota 4Runner, Alona M. Williams (B/F/Age 20) of Baton Rouge, LA, sustained serious injuries and was airlifted by Acadian AirMed to Our Lady of the Lake Hospital in Baton Rouge. The driver of Saab, Scott M. Gilbert (W/M/Age 27) of Houston, TX, sustained minor injuries, but was not transported. Currently troopers are working to locate the driver of the Nissan Maxima.
If there are any witnesses to this crash or if anyone saw the Nissan Maxima with the Louisiana license plate number OTE 951, State Police Troop A is asking that you contact 225.754.8500.

In the early 70's, at a time of forced school busing and high racial tension, Mr. Patrick came to Poland High School from Wettermark. Mr. Patrick was one of those type of teachers that they make movies about. He took great interest in his students, and was widely liked by all. I can remember his science class gave him a suprise birthday party, the size of which I do not recall for other teachers. We missed him when he was transfered from Poland, and he will be missed in this final transfer.

phishing walmart
a little while ago we read this news item wal-mart's holiday opening disappoints via the town talk then a few minutes later noticed we had received several walmart based phishing emails -- to gmail's credit they were sorted to junk. naturally this made us wonder if the phishing had something to do with it. nah probably not. perhaps, could it be walmart's growing public perception as an evil empire?
anyway, one tip off that this is a phishing scam is that walmart has no reason to have our email address. we've never used this email address to order anything online much less from walmart or sams.

next, in order to to confirm our suspicions we look up (whois) the domain walmart-estore.com to see if its a walmart owned domain or not. -- its not.

more quinn family nonsense
yesterday, in "your mail" the town talk published a spam captioned: 'State needs Jindal's leadership.' by james quinn. (btw heres some real "jindal leadership" for you other than this jindal garbage mr. quinn would have us believe) one reason its spam is because at least as of the time of this posting the town talk left out the usual disclaimer that mr. quinn is executive director of the louisiana republican party. its spam because mr. quinn's mother louisiana state senator julie quinn has been outted in our fake republican watch series, its spam because the louisiana republican party chairman -- RINO -- roger villere is not doing his job according to the republican party platform, policy or ideals. its spam because the louisiana republican party is FUBAR and its spam because we shouldnt listen to these people they dont know what the hell they are doing...or do they? :-|
dont get the wrong idea, we've had it with both parties, we dont support a governor blanco reelection either.
instead we will vote third party candidates: the libertarian party, constitution party, INDEPENDENTS!...and you should too. ;-)

wikipedia didnt have an entry on Rumourdely so we made an entry -- in our original entry we hypothesized that rumourdely was used at first by barristers in the victorian era. a few minutes after making the entry a high up wikipedia muckety muck editor weighed in with this:

we were channel surfing the other night or channel sharking as it should be called because most of the time we feel like if you stop surfing you die. lol. occasionally there are some good programs to watch um mostly on c-span.
at cnn we were reintroduced to roseanne again for the first time in a long time last week on larry king live. we caught the portion of roseann's interview when she is talking about the internet and how fantastic it is theres a video clip of a portion of her interview here. roseanne mentioned her blog roseanneworld.com and how she loves blogging and will "run up there" and post anything on her blog that comes into her head or stream of consciousness. lol.
so we went over and checked out her blog and its pretty good. we posted about roseannes take on the fox news, rupert murdoch & oj simpson debacle. then, yesterday evening we logged on roseanneworld.com to read roseannes latest post and maybe we are all wrong and misread her being new to her blog and all but the tenor of it unsettled us. we would have left a comment there instead, but the blog doesnt allow for them. the way we read it it seemed like an easy swipe on roseannes part against tom arnold.
anyway, we sent roseanne the following email and we really hope that she lets us all know that indeed tom arnold and her have buried the hatchet.

dear roseanne, we read your most recent post on tom arnold with some sadness on your end because by it you seemed to be projecting negativity in mr arnolds direction; in reading your past blog entries we cant see how that this is in keeping with the philosophies claimed by you to believe in....using each other to make the other one look good works both ways :P some of us perhaps a small fragment of us enjoyed your and mr arnolds professional association. we like both of you equally and remember that time as a special time in our lives. the jackie thomas show that you got for mr arnold which was a good show for both of you then rumourdely you yanked it when he pissed you off. maybe by now you regret that...or not. perhaps a reason mr arnold will only address you before an audience is because he feels that only with witnesses will you keep your word or anyone would take him seriously. of couse we have to take into consideration that you two lived together; that we werent there for personal nastiness -- from both sides. -- but thats not the point of this...all we want to say is that we care about both of you and when you hurt each other on purpose it hurts us double. bury the hatchet with tom arnold.EXTERNAL LINK

A champion to his community, a strong believer in fire safety and a true family man. Michael Lawton of the Holiday Park subdivision passed away tragically yesterday and as News Channel 5's John-Thomas Kobos found out, Lawton paved the way when it came to protecting the ones he loved most.
The Lawton family has planned a visitation on Saturday November 25 at Hixson Brothers Funeral Homes in Pineville from 11am to 3pm. At 3 a memorial service will be held.

Michael Joseph Lawton Jr., "Mike" passed away unexpectedly November 22, 2006 while working on the property that he loved. Since his retirement, Mike spent his days developing his property, working on projects, and indulging his passion for large equipment. Mike was a one of a kind husband, father, grandfather, and friend. His unique personality was one that left a lasting impression on the many lives that he touched.
He leaves behind a wife of 46 years, Diane Bives Lawton and three daughters, Laura Lawton and husband Glenn Thomas of Breaux Bridge, their two daughters, Sarah and Rachel Thomas; Dana Lawton of Baton Rouge, Stacy Lawton Gauthreaux and husband Chris of Brusly, their two sons, Max and Clay, and his sister, Fay Lawton Keenan of New Orleans. He was preceded in death by his father, Michael Lawton Sr., mother, Agnes Gaudet Lawton, and mother-in-law, Lois Bives. Mike graduated from DeLasalle High School in New Orleans, and received a B.S. in forestry from L.S.U. in 1958.
Mike moved to the area as a forester with Pineville Kraft Corp and retired from Colfax Creosote Co. He was owner and operator of Lawton Forest Products, and was an independent timber consultant in Central La. area until his death. He was a founding member of the Holiday Village Fire Department, serving as president for 18 years, and remained an active member of the department throughout his life. He was a lifetime member of the La. State Fire Association (LSFA) and the La. Jacyees and previously served as a member of the Republican State Central Committee. He will be missed by many and will be remembered his numerous sayings or "Mikeisms'.
Funeral services will be at Hixson Brothers in Pineville, La. on Saturday, November 25 with visitation from 11-3 with a memorial service following in the chapel. In lieu of flowers, the family would like to honor Mike's wishes and request donations be made to the statewide fire fighters LSFA James C. Cahanin Scholarship Fund, 140 LeBlanc St., Ponchatoula, LA 70454.
