kalb mysteriously quiet on latest mayor-city council-cleco lawsuit controversy

added 6:56 am cdt monday 02 april 2007 now we're not lawyers we just watch a lot of law and order and in that middle video, the bridgett brown video, city attorney charles johnson plainly asks the city council for permission to file a "motion to determine counsel." the city council president everett hobbs just laughed at mr. johnson....then perhaps the most strangest and most telling event happened in this whole episode -- councilman lawson chimed in that he was under the impression that ms. brown was "still on the case they (mayor & city attorney, etc.) under the impression shes not, i think if we move forward we're not gonna solve it here i say that we move the meeting and thats my position." what exactly does this mean "move the meeting?" move the meeting to where? out of the public eye?

and "not gonna solve it here" thats disturbing because thats exactly where it should be solved - in public; in a public meeting. so then the city attorney reiterates his request to file his motion and the city council hem-haws around for a little while and councilman lawson is again adamant in his position to adjourn the meeting. now like we wrote earlier we arent lawyers but it would seem to the casual observer that if mr. johnson would have been given permission to file his motion that would have given the city the advantage because it would have put the ball in ms. browns court to show that she was right and the city wrong. now ms. brown has filed papers that would seem to give her an advantage and make the city have to prove its position is correct.

even though most if not all of the city councilmen might be friends with ms. brown and all that - their first duty is to the city. so how can the citizens of alexandria expect their city to be properly ran when their own city council doesnt act in the citys best interest?

Alexandria removes Brown from Cleco case

Bridgett Brown told the Alexandria City Council on Tuesday that she is still its attorney in the ongoing Cleco Corp. case, despite receiving a letter almost two weeks ago stating she was off the case.

Brown's and others' statements Tuesday were the first confirmation that Brown had been relieved of duty by the city attorney for Mayor Jacques Roy.

last month kalb couldnt wait to post footage of the 27 february 2007 alexandria, louisiana city council meeting. permalink here.

this month (13 march 2007) another controversy erupted when a friend of ms. brown, tony clayton, addressed the council and said that the mayor didnt have any authority to remove ms. brown from the cleco case. then ms. brown personally addressed the city council and said practically the same thing. kalb hasnt posted any of this video or even mentioned it on their website. what gives?

    today, the alexandria daily town talk published two stories [one here and one here] relative to the ongoing louisiana attorney general and rapides parish district attorney investigation into the alexandria, la. city council.

    we believe that a commenter on the alexandria daily town talk forum who calls himself love4aex is actually bridgett brown's brother garry brown. mr. brown who has previously been caught running comment scams on both kalb.com and the town talk, lives in north carolina not alexandria, la. mr. brown, in a rather lame and futile effort to sway public opinion, must be working in concert with the alexandria, la. city council's "bridgett brown 5" and should be investigated himself.

    note: all copies of documents and the video are made available to wst... and to you, courtesy of local attorney and blogger gregory r. aymond public records request. wst... spoke to mr. aymond by phone and we asked him why he filed his public records request his response was that he couldnt comment on that.

    on tuesday 12 june 2007 the alexandria, louisiana city council held a meeting and according to the city's agenda (copy here) the meeting was to be held pursuant to La RS 42:6.1 (A)(2). agenda item C 1) states: "to consider an executive session for an update from the administration regarding the matter of "city of alexandria vs. cleco corporation, et al"

    sometime prior to 11 june 2007 attorney bridgett brown filed a "petition of intervention" which in effect made her an adverse party to the city of alexandria because ms. brown's petition was made part of the ongoing city of alexandria v cleco corporation lawsuit in the united states district court for the western district, alexandria, louisiana -- see civil action number 05-CV-1121-A.

    according to ms. brown's intervention petition she was a special counsel to represent the city of alexandria in city of alexandria vs. cleco corporation, et al. ms. brown's "contract for legal services and contingent fee" (page 2, page 3) is attached to her petition as exhibit one.

    all five letters say the same thing the only difference between each letter is the name and signature line(s)

    on 11 june 2007 five alexandria, louisiana city councilmen: city council president and district two councilman everett hobbs, city council vice president and district one councilman louis marshall; the two at large councilmen myron lawson and roosevelt johnson and district three councilman charles frederick smith, jr. each signed a letter to inform city attorney charles "chuck" johnson, the mayor jacques roy and the chief operating officer kay michiels that "it is our intent to enforce fully the terms of the agreement entered into by the city with ms. brown."

    the councilmen's letter ends with "both the administrative and the legislative bodies must operate within the powers granted it under the city charter." then an admonishment to johnson, roy and michiels that they should "...read the charter and adhere to its provisions." thats real funny the councilmen would write this because the alexandria city charter at part 1, article IV administration: section 4-02 legal division (c) clearly states: "Any assistant city attorneys authorized by the city council shall be appointed by the city attorney and serve at his pleasure."

    while its true that section 4-02 (D) states that "No special legal counsel shall be employed by the city except by written contract and approval of the city council." this is a moot point because you cant sue the city while at the same time be a city attorney...you follow? additionally the attorney rules of professional conduct prohibit it -- see : rule 1.6. confidentiality of information; rule 1.7. conflict of interest: current clients; rule 1.8. conflict of interest: current clients: specific rules; rule 1.13. organization as client. additionally, as charles johnson explained, the federal judge has already signed an order dismissing ms. brown as an attorney for the city and she has not signed a confidentiality agreement that the federal judge required to be privy to the mediation. therefore, how could ms. brown be in attendance at the executive session discussing these matters? all lawyers knew that, as is seen in their refusal to attend that meeting if ms. brown would be present.

    according to mayor jacques roy, these letters were not delivered to the recipients johnson, roy and michiels until shortly before the 12 june 2007 city council meeting.

    heres where things really get interesting.

    the city council meeting was called to discuss the cleco litigation and the armested franklin v city of alexandria suit, which the last we heard is in ninth judicial district court division "f" (judge george c. metoyer) docket number 228,034. ms. brown is suing the city due to her intervention petition; her attorney is larry english and mr. english is also the attorney who is handling the armested suit. despite all this at least five alexandria city coucilmen are adamant about allowing ms. brown to attend the executive session in which the very suit that she is an adverse party to the city would be discussed and additionally a suit in which her attorney is representing the adverse party was to also be discussed. this is explained better in the video below where attorney trey gist says words to the effect that you cant sue the city and be the citys attorney at the same time.

    can you see the deception? can you see what at least five alexandria city councilmen are trying to pull here? where is the rapides parish district attorney at? where is the louisiana state attorney general at or the louisiana state police or the louisiana attorney disciplinary board? as we see with the poverty point reservoir scam and the louisiana institute of film and technology scam is it going to take the fbi to come in and clean up yet another louisiana corruption problem?

    bridgett brown is a trip

    loony looziana state attorneys are always good for a laugh; this isnt the first time ms. brown has acted so undignified -- in a 12 june 2007, special city of alexandria, la. council meeting her behavior was so embarrassing that her pals on the city council banned the governmental public access channel from ever rebroadcasting the meeting.

    in yesterday's video that this screen grab is taken from, ms. brown displayed her sign upside down most of the time.

    then, there is that other alexandria attorney, greg aymond, (who claims that he is a "former" member of the ku klux klan) who called some members of the alexandria city council a pack of nigger street thugs. of course there are attorney's like morris bart who's television advertisements liken his legal prowess with winning the lottery, i.e. "morris bart got me three hundred thousand dollars!"

    all these show is that anyone in louisiana can pass law school and the louisiana state bar and that there is nothing special about lawyers and the practice of law at all - they are common as hell.

    the loony looziana state bar needs a rule similar to what they have in the military about conduct unbecoming an officer - they need a rule about conduct unbecoming a lawyer - or if they have one, they need to enforce it. lawyers need to have some pride in themselves, how the public perceives them and perhaps, more importantly - in their profession.

    bridgett brown attorney larry english: heh heh heh ethics board member michael t. johnson 'acted illegal and inappropriate'

    the gannett/town talk has an update to their story involving todays scheduled ethics board hearing on alexandria, la. city councilman myron lawson and attorney bridgett brown.
    excerpt:

    Last fall, Lawson and Brown were charged with violations. Lawson was is accused of receiving rental payments from Brown for space in his office building during a time she held business relation with the city government and of voting to retain her legal services when it was prohibitive.

    Brown is charged with leasing office space from Lawson during a time when she entered into a contractual relation with the city in two separate occasions. The case was originally set for a hearing in January, but has been postponed several times.

    On Thursday, English argued Michael T. Johnson, an ethics board member, who is from Pineville, violated ethics rules when he voted to recommend an investigation of Brown during the initial hearing, but later recused himself citing a conflict of interest.

    Attorney Michael Dupree, who represents the board, said it was the first time he heard of Johnson’s alleged violation. Dupree and board members, including Chairman Henry C. Perret, Jr., said they recall Johnson properly recusing himself at every step of the way.

    Board member Dolores Spikes also said she remembers Johnson has always recused himself on matters related to the city of Alexandria.

    English introduced an official document, he said, evidences Johnson’s vote at the initial hearing. “We believe that this whole hearing in light of that vote is illegal and inappropriate,” ~ read more

    bridgett brown's latest petition offers a glimpse into how organized crime gangs operate in central louisiana

    UPDATE: unethical alexandria, la. attorney greg aymond, in full damage control mode, attacked this post from his blog. however, the discerning reader should note, that he did not deny what we wrote either. - at least in the version that we saw.

    Sometime in 2005, at the dedication of the police memorial for fallen Police Officers, Chris Roy Sr. approached Kelvin Sanders and stated that the City did not need to hire their own lawyers to represent it in the CLECO controversy that "they" could represent the City and Sanders responded that would be inappropriate "that a first year law student could see through the conflict."

    The City then hired Intervenor [bridgett brown] along with Attorney John Sharp, Attorney Craig Davidson and Phillip Hunter in a contingency contract that stated that Intervenor would receive ten (10%) percent; John Sharp ten (10%) percent; Craig Davidson ten (10 %) percent; and Phillip Hunter five (5%) percent, of any over billings recovered.

    In the spring and summer of 2006 on three different occasions [jacques] Roy and Chris Roy Sr. who represented [samuel] Sansing contacted Intervenor and tried to pressure her into withdrawing from the case so that EMS [EMS is owned by David Pugh and employed Samuel Sansing who are former employees of CLECO] could increase its percentage of fees and on at least one occasion during the same period Roy and Chris Roy Sr. personally visited Intervenor to pressure her to give up her contract so EMS could increase the amount of its fees in its new contract, and Intervenor refused.

    Sometime in 2006 Attorney Michael Johnson who represented David Pugh came to see Intervenor and tried to pressure her into withdrawing from the case so that EMS could increase the amount of its fees in its new contract, and Intervenor refused.

    wst... note: this paragraph resonates with us -- we made some posts critical of the city of alexandria renewing its channel 4 and city website management agreement with kja communications group, which is owned by david pugh.

    mr. pugh contacted his attorney, michael johnson, who in turn contacted his good friend, unethical alexandria, la. attorney greg aymond, who in turn contacted us, attempting to pressure and intimidate us into retracting our post(s) and then to unequivocally support the kja contract renewal.

    we told mr. aymond to go jump in the lake; that we are not interested in being a part of, or working with, the criminal network.

    as a result, mr. aymond began to attack us from his blog and stepped up his attacks when it was revealed exclusively from this blog that alexandria, la. mayor jacques roy's brother, state representative chris roy, jr., awarded a tulane legislative scholarship to the daughter of samuel sansing.

    it's unknown what, if any, consideration mr. aymond received then or has or is receiving in his attempts to subvert and propagandize the local blogosphere.

    Intervenor believes that sometimes in the spring and summer of 2006 Roy, Chris Roy Sr., and Michael Johnson went to Phillip Hunter and pressured him to withdraw from the case in which he did,

    As a result of Phillip Hunters withdrawal from the case, the City approved the new EMS contract at twenty (20%) rather than the original fifteen (15%) percent it was scheduled to receive.

    Sometimes in October 2006, while Jacques Roy was in involved in a special election for Mayor of Alexandria, Roy, Pugh, Sansing, Attorney Aaron Siebeneicher, Intervenor, John Sharp, and City Attorney Kelvin Sanders, Craig Davidson and David Pugh met to discuss how much money EMS believed that CLECO owed the city and at that meeting Kelvin Sanders again expressed to Roy that if he won the mayor’s race, he would have a conflict and should not participate in the CLECO case.

    Sometime in December of 2006 [mayor roy was sworn into office on 04 december 2006] Roy in a meeting in which Sanders was present, indicated that he was setting Notice of Deposition of Board members of CLECO in the CLECO vs. Sam Sansing, et al and Sanders again warned Roy that he should not be participating in either the City Of Alexandria vs. CLECO and CLECO vs. Sam Sansing, et al.

    At all times after his election Roy continually acted as the City of Alexandria lead attorney in City of Alexandria vs. CLECO directing all discussions and legal tactics.

    Sometime in early March of 2007 Intervenor received a phone call from Tommy Antoon who stated he was calling on behalf to the Mayor and told Intervenor that if she would not fight her removal from the case and “send her resume”, she would receive city legal work. Intervenor declined the offer.

    wst... note: this might have been one of the phone calls ms. brown was referring to in her 13 march 2007, address to the city council, when she said "i've gotten calls from several people in the last two weeks, explaining to me that 'dont worry you'll get an hourly wage and you'll get a couple of hundred dollars for the work that you've done.'"

    Sometime in March of 2007, Intervenor, City Attorney Charles Johnson, Attorney Kelvin Sanders, Malcolm Larvardain and Attorney Edward Larvadain, Jr., met for lunch and at that meeting, Johnson informed Intervenor that Roy was acting as the City Attorney in this case and that even he was not allowed to “touch it” and that no African-American lawyers would make any money out of this case and that Intervenor would not receive her contingency fee because it should have gone to EMS.

    wst... note: this is perhaps the most fascinating paragraph in ms. brown's amended petition. a preceding paragraph --paragraph 36, (see also paragraph 39) of the petition states that ms. brown was terminated by the city attorney, mr. johnson, by letter she received on 28 february 2007.

    now here it is less than a month later and she is having lunch with him? how many people have lunch with someone who just terminated their employment, especially under such contentious circumstances?

    also is ms. brown suggesting that mr. johnson while lamenting that "no african-american lawyers would make any money" out of the case was leaking information to her and others? is ms. brown suggesting that city attorney johnson was violating the protective order that issued on 19 january 2006?

    additionally, in that 13 march 2007, city council meeting, ms. brown addressed the council and made her argument that she was still in the cleco case. the city attorney, mr. johnson, in his response to ms. brown's statement said that "very little of it was true factually, very little of it was accurate legally." ms. brown also played "the race card" and was called on it by city attorney, johnson. looking back at the meeting now, we wonder if what we were really witnessing was a dog and pony show.

    During the mediation Council members had to separate Roy and John Sharp who were arguing, Sharp rebuked Roy for participating in the mediation as he had a conflict, however, Roy ignored Sharp’s recommendation and according to the Alexandria Town Talk:

    wst... note: this paragraph doesnt make any sense because the preceding paragraph, paragraph 42, says in part that, "no council member were allowed to participate in the mediation." the mediation was held on 26 and 27 march 2007 and around six months later, on 06 september 2007, the city council issued a cryptic statement at mayor roy directing him to cease and desist all involvement in the cleco case.
    what needs to be done here is a complete investigation of this case by some outside, non-local and non-louisiana state, agency.

    at this point, how can any alexandrian, after witnessing all these back-and-forth lawsuits, allegations, bizarre behavior and so forth, really believe that the cleco case has been handled in an honest and forthright manner by all party's involved without all the party's being first subjected to some sort of independent investigation verification?

    alexandria, la. city council prez everett hobbs plays the race card again

    check this out...alexandria, louisiana city council president, everett hobbs and four other city councilmen (the bridgett brown 5), who just happen to be black, are caught red handed violating the open meetings law and the way they were caught wasnt the result of any investigation or anybody following them around etc -- they were caught by letters that they signed themselves and they were caught on video tape discussing it at city council meetings in which they knew they were being video taped at to begin with.

    so, mayor jacques roy puts out a call for citizens to demand an investigation and one person answers mayor roy's call. a local attorney who just happens to be white. so what does council president hobbs do? he hollars racism. in fact anyone that dares to question his or the other members of the bridgett brown 5 crime gang actions and/or motives are branded as racists as well. such as councilman hobbs accusation of racism hurled at the alexandria daily town talk in a recent your mail from him to them.

    this all brings back to mind an incident this past spring of 2007 when a local pastor, the reverend leroy johnson confronted councilman hobbs and gave him a good dressing down. is reverend johnson a racist too?

    town talk pronounces alexandria city counsel prez everett hobbs a failure

    kudo's to the alexandria daily town talk for not falling for or being intimidated by alexandria city counsel president everett hobbs recent charges of racism. we also like the way that the town talk turns it around and puts the focus squarely on the remaining six city councilmen to do something about their failing leader:

    The body for which he speaks includes six other council members: Charles "Chuck" Fowler, Roosevelt Johnson, Myron Lawson, Louis Marshall, Harry Silver and Charles Smith Jr.

    The councilmen have chosen and endorsed Everett Hobbs as their leader, so they are the chorus behind what their leader says. They can sing his praises, or they can remain quiet. It's their choice. Either way, through praise or silence, they say the same thing: that they support their leader.

    On the other hard, they can choose to criticize their leader -- because they disagree with him, because they think he stepped over the line, because they think he is wrong about something, or because they think he may be unfit to handle the responsibilities of the position.
    so will the remaining six city councilmen step up to the plate and remove president hobbs? we're not very encouraged since it appears that president hobbs together with at least four other councilmen (the bridgett brown 5) appear to be operating together in the same organized crime ring.

    perhaps if state attorney general charles foti had spent as much time, money and energy enthusiastically investigating and prosecuting corrupt public officials as he did prosecuting dr. anna pou he just might not be facing such a hard struggle for reelection.

    Alexandria City Council Erupts in Fight over Lawyer - Part 1

    In the video below the Mayor of Alexandria Jacques Roy and City Attorney Chuck Johnson are engaged in a heated conversation with City Councilman Myron Lawson. At issue is what power the city attorney has and if he has the right to take a legal position for the council without its approval.

    You may recall the council was to meet in executive session to hear an update on the CLECO mediation. The meeting ended and the council met with the mayor in open session to hash out the issue of what lawyers can or can not be present for the executive session. Most of the arguments stem from the idea that councilman feel they are not being told the details about the CLECO mediation and some want to allow attorney Bridgett Brown to attend closed door meetings.

    the other day in a post we captioned is cenla antics republican propaganda? we mentioned how the logo on the cenla gopac website banner looks like a pentagram. as a result of our post we were slammed on cenla antics blog:

    then yesterday the delores brewer for mayor campaign released a television commercial in which the camera points to a brown piglet when the name of a local african american attorney (bridgett brown) is mentioned. (you may view the commercial on kalb.com's video blog by clicking here.) this was immediately picked up on by another anonymous commentator over on cenla antics:
