wafb-tv has broadcast a report and it turns out that state representative yvonne dorsey, is the legislator behind earmarking state taxpayer funds to the purple circle social club, the colomb foundation - which according to wafb is the nonprofit that belongs to ms. dorsey's boyfriend and other shady state expenditures.

this morning on his radio program moon griffon was talking about house bill no. 1: the appropriations bill and questionable state expenditures contained therein...one example mr. griffon used was $50,000 [37.2 eur] to a non-profit called "purple circle social club."

the first thing we did was go to legis.state.la.us and look up hb1 and try to find the expenditure in question. after about six cups of coffee and two extra-strength tylenols later we finally found it all the way down on page 274:


the next thing we did was go on the sec'y of state corporations database and look up "purple circle social club:"

somehow, we werent surprised to learn that purple circle social club is not in good standing with the sec'y of state. in fact they havent filed an annual return in two years. the next thought that comes to mind is why is the state giving $50,000 of taxpayer money to a "corporation" that cant even keep its corporate charter in good standing with the state? then the next thought was if this "corporation" wont file required paperwork what makes the state think that they will spend all this money in the way that its supposedly intended? maybe we are missing the point here and purple circle social club is spending the money the way the legislators intended.

the expenditure immediately preceding the purple circle social club payout caught our eye too. it's $300,000 [223.1 eur] to something called the colomb foundation inc.

this is an interesting kick-back err state expenditure too because an 02 june 2006 audit of the colomb foundation, inc., 2005 books, shows that it only had $60,000 [44.6 eur] of income for 2005. audit in html or .pdf. the act 1 mentioned in the auditor's report was the appropriations bill for 2004.

so apparently all you have to do to make some easy money in this state is set up a non profit corporation, next get your state representative or senator or some legislative staff member to place your companies name and a number in this loooong list of expenditures and you're all set. notice as you scroll down that list how they throw in some legitimate looking expenditures such as the pointe coupee animal shelter or the town of richwood for the police department. this accomplishes two things -- (1) it breaks up the monotony and (2) gives the document an air of credibility.

june 2007 wafb & caroline moses catch state representative yvonne dorsey red handed using her office to give away citizens tax money in the form of $50,000 to a near defunct 'social club' ~ the purple circle and giving away $300,000 to what wafb called her boyfriend -- to his non-profit, the colomb foundation.

of course nothing happened and now ms. dorsey because shes term limited from her seat in the house of representatives and because of a "quirk" in louisiana's term limits law is running for state senate.

this is the laaaaaast person that needs to be in an office of public trust. in fact rep. dorsey should be investigated. sadly cleo fields disappoints in his choice for a successor and shows that for more reasons than one that the state supreme court in his case made the right decision..

To see a list of non-governmental entities, the lege who requested the funded for it and the amount of your state tax dollars to be put in the State Operating Budget (HB 1, 2008 R.S.) go here.

The current total is $13, 985,227.00.

Note, that this is just the start. The Operating Budget is still in the House Appropriations Committee. The organizations and amount will grow as the lege session continues. Additionally, this does not include all the state funding going into purely local governmental entities.

Now you know why you aren’t getting a tax reduction or rebate from the $1 Billion in excess state revenues.

HB 2 of the 2008 Regular Session is the State Capital Outlay Budget. Most of the expenditures in that budget is from money BORROWED via State General Obligation Bonds.

Thus, not only are we giving NGOs state cash, but now the state is borrowing money to fund NGOs. This, despite record budget surpluses.

I went through HB 2 and selected a few examples of money being borrowed for NGOs. I only listed those which are in Priority One, meaning they will get funded this year from the proceeds of bond sale(s).

The sample alone totals over $24 MILLION. This may help explain why, despite Jindal’s veto of $16 Million in NGOs in the Operating Budget the leges overwhelmingly voted against having a veto session to attempt to override the vetoes. ~ read more

today, the gannett/monroe news star has printed an article by greg hilburn captioned 'jindal rules reign in earmarks' which lists some (so far) forty-four, northeastern louisiana non-governmental organizations, project requests totaling $20,701,343 just by legislators in the area of the monroe news stars readership.

so far, the gannett/alexandria daily town talk has given a total pass to cenla legislators non-governmental funding requests. why?

alexandria, la. citizen wants to know about cleco fraud suit settlement utility rebates

on 10 february 2009, the city of alexandria council held a public hearing to receive public comment concerning electrical utility rebates relative to the settlement of the cleco fraud suit.

ms. gayle underwood asked a question concerning so called rebates to alexandria utility customers who were overcharged during the period of time that cleco was overcharging the city for utility service.

such talk of rebates to individual utility customers is a waste of time. besides being conveniently next to impossible, if not impossible outright, to calculate these rebates, there never was going to be any such rebates.

talk of individual rebates was just a contrivance the city used to build public support to go ahead and settle the suit.

instead, what you're going to see when the city finally gets its money, whatever the amount, is an explosion of "professional service contracts."

for an example of what we're on about, look no further than to the loony looziana legislature, where we see this technique, year-after-year by how they launder money to their criminal friends with the so called "non-governmental organizations." this is how they get the money out.

in a letter dated 30 april 2008, louisiana governor piyush "bobby" jindal issued his list of criteria regarding the use of state tax dollars to fund non-governmental organizations (ngos). [download letter here]

in louisiana non-governmental organizations are usually non-profit corporations set up by legislators cronies to appear to legitimize the receipt of what used to be called slush funds or earmarks. in reality its just a way for legislators to launder tax money back to the politically connected.

on monday 05 may 2008 district 105 state representative ernest d. wooton republican from belle chasse, la. used a personal privilege to address the house. representative wooton took exception to governor piyush's 30 april letter and called it "a threat" because as rep. wooton maintains that the letter was sent out without the input of anyone -- including any house committee. rep. wooton pointed out that the state budget and the appropriations process is a function of the legislative branch and not the executive branch.

however, the most revealing statement given by rep. wooton was right after he quoted the final line in the 30 april letter in which gov. piyush states that "i look forward to working with you as the legislature continues its work on the budget." rep. wooton said that in his opinion and his opinion only -- governor piyush "bobby" jindal has not been working with the legislature "at all -- then dictating to us what we can and cant do or hes going to veto it. these are his stipulations, if we dont follow his stipulations then we pay the price or our districts pay the price, our constituents pay the price and i find that offensive."

curiously, a search of non-governmental funding requests from the state legislature website shows that rep. wooton has not requested any ngo funding as of the date and time of this post.

a gannett/town talk 'your mailer' is doing their job for them again

this morning, the gannett/town published a 'your mail' by terry smith of pineville, la. the town talk captioned it 'thank you, state rep. dixon!' see link.

mr. (or ms?) smith wrote in to list some of the non-governmental funding requests (a/k/a/ slush funds or ear marks or more accurately money laundering) by state house district 26 representative herbert dixon.

by a citizen having to take the time to write in to shine some light on something the town talk in the normal course of reporting 'news' should have already printed.-- this is a pretty strong indictment of the town talk's journalistic integrity, or lack thereof.

we're not singling out rep. dixon to pick on -- the town talk has printed nothing, zip, nada about any cenla legislators non-governmental funding requests -- or their tulane legislative scholarship awards.

we noticed that some yvonne dorsey supporters had been arriving at our post about the purple circle social club. representative dorsey supporters were trying to paste a rebuttal into the comments of a related post but it looks like haloscan comments has a limit in the amount of text one can enter into a comment.

luckily, one of ms. dorsey's supporters left her email address and we emailed her to let her know that if she would send us a copy of what it was she was trying to post we would post it in its entirety...coz we're nice like that...

Over half a million dollars and still counting – he definitely won’t be looking out for our interests and he is definitely a Democrat in name only!

We are confident Yvonne will continue the great work she began as a State Representative:

state senator yvonne dorsey is correct in her observations. however, whats unfortunate about it is that they are within the context of non-governmental organization funding. the funding of which is justifiably unpopular thanks to her and other leges past abuse. so look for sen. dorsey and her words of wisdom to be laughed at, marginalized and swept aside.

Senator Yvonne Dorsey, one of the two most senior members of the Legislature for East Baton Rouge Parish, reacted on Monday to Governor Jindal's announcement that he has issued 258 line item vetoes against HB1 , the state's principle budget bill.

Dorsey said, “No intelligent person can believe that HB1 contained that many problems after the administration itself spent so many months stirring the pot while we had it on the stove. Jindal has made a mockery of the line item veto and I am confident that we'll have the votes to put a stop to it.

All of his vetoes are just political grandstanding aimed at feeding his ridiculous Presidential ambitions. I used to think that his political greed was just pathetic but now he's hurting ordinary citizen, especially children and the elderly.

Can you believe he vetoed the YMCA? A Boy's and Girl's Club? Habitat for Humanity...twice, once in HB1 and earlier in the budget supplemental? Programs to help children in court? Meals for the elderly? This arrogant political climber is punishing our state's children, our Katrina victims, and the elderly just to set himself up for a hopeless run at 1600 Pennsylvania Avenue in four years.”

“With these vetoes he has single-handedly undone all of the benefits of the Federal stimulus program in Louisiana by shutting down assistance programs and killing jobs while depriving our economies of the further stimulus effects which we had passed. Each of these programs would have had a multiplying effect in local economies all across our state. Now hundreds of organization will be shutting down or firing people.”

Dorsey pointed out that Jindal has already used the line item veto more times in a mere seven months than the last two Governors combined. “That's obviously an outrageous abuse of the line item veto. He is attempting to arrogate to himself the revenue powers which constitutionally belong only to the House and Senate. This kind of attack on our constitutional authority cannot be tolerated.”

“The Constitution specifies that the line item veto is a last ditch defense to allow a Governor to keep spending within budget, yet HB1 already gave the state a $2.5 billion surplus using revenue projections with oil at just $88 per barrel. By now our true surplus is at least $3 billion. The line item veto was never meant for this kind of arrogant abuse.

Anyone can see that all of his picking and choosing was based on devious political motives. He is letting $36 million worth of amendments stand, most of which are just like the $17 million worth that he has vetoed. He calls some programs regional while the same things elsewhere he says are local. For example, he has the audacity to tell us that the Baton Rouge Balloon Festival, which generates hundreds of thousands of tourism dollars for the Greater Baton Rouge Metropolitan Area, is 'local.' Everyone for fifty miles in any direction has seen those balloons flying and knows better. The man's an idiot if he thinks he can fool voters with this latest Jindal Swindle.”

Dorsey says that she has had direct experience in the Legislature with four different administrations. “Jindal is the first whose word simply cannot be trusted. Both he and his staff are blatant liars. We've caught them time and again telling one person one thing and ten minutes later you find out they've told someone else the exact opposite.

Everyone in the Legislature is on to them and we're getting pretty fed up with these Jindal Swindles.

He promised ethics, but gave us a toothless Ethics Commission and a trail of sabotaged bills designed to keep the Governor and his staff from having to comply. He promised jobs, but only gave us a new label slapped on the Department of Labor and an annual $370,000 salary for a do-nothing glad-hander.

He line item vetoed the state's one and only job training appropriation from the supplemental budget bill. He promised transparency, but gave us more of his double-talk, lies and political grandstanding. We've been fed one Jindal Swindle after another from this administration and I sincerely hope that the Legislature is now in a mood to a period to this man's lifetime of inflated stories about himself. the thing is though -- is that according to google that number belongs to vincent general store, 1000 northgate road, bossier city, la.

hb1293 chris roy jr.'s 'atrocious' red river, atchafalaya, and bayou boeuf levee district bill

via the dead pelican we learn that rep. chris roy, jr., has made the news in the gannett/opelousas daily world (see link). this news never appeared in the gannett/alexandria daily town talk, (rep. roy's hometown paper) and its interesting that if you follow news aggregators (like the dead pelican for one) to observe how gannett reports news in some areas and suppresses the same news in other areas of the state by their ownership of most of louisiana's major daily newspapers. on the other hand gannett does share stories back and forth when it suits their agenda. we examples of this over and over again.

anyway, it seems that there is a power struggle between rival crime gangs for control of the red river, atchafalaya, and bayou boeuf levee district and rep. roy's hb1293 (coauthored by senator joe mcpherson) will remedy that.

The Red River, Atchafalaya and Bayou Boeuf Levee District (the District) was created by Louisiana Revised statute R.S. 38:291(M). The District includes all or portions of the following parishes: Avoyelles, Rapides and St. Landry. The District provided flood protection for those area contained in the District. The Board of Commissioners administers the operations and responsibilities of the District in accordance with the provisions of Louisiana statutes. The three members of the Board of commissioners which governs the District are appointed by the governor of the State of Louisiana. ~ louisiana legislative auditor financial report 30 june 2007 - page 20.

we see that the red river, atchafalaya and bayou boeuf levee district has substantial assets and has a steady income stream from off of ad valorem taxes. thats another thing, for all the multimillions of dollars the legislature squanders on non-governmental organizations we see that the state could easily fully fund the red river, atchafalaya and bayou boeuf district and remove the ad valorem tax burden from off the people - but they're not gonna do that cos it makes too much sense. plus they wouldnt have as much slushfund (ngo) (tax-payer) money to launder back to their criminal friends.

one problem we see with rep. roy's bill is that it only allows members who have been nominated by that parish's legislative delegation -- see thats ignorant. why not allow qualified applicants to apply and then let the governor, with the advise and consent of the state senate, choose from them? wouldnt this help to recruit qualified, talented and innovative individuals to serve?

The American Press on June 6 submitted a records request to House Appropriations Committee secretary Janis Batchelor for copies of the amendment forms legislators must provide to the committee to secure state funds for nongovernmental organizations in the state budget. Batchelor forwarded the request to House of Representatives Clerk Alfred Speer, who responded the next day. Below is the complete text of Speer’s letter sent to the American Press:

On June 6, 2007, you requested “all NGO Amendment forms submitted by legislators to the House Appropriations Committee in 2007.” I am the custodian of the records of the House of Representatives (House Rule 2.10D(2)) and am responding in lieu of Ms. Batchelor.

R.S. 44:32(D) requires I inform a requester of any privilege which exempts documents from disclosure under the Public Records Law.

LA Const. Art. III, Section 8, as interpreted by the LA First Circuit Court of Appeals in Copsey v. Baer, 91-0912 (Dec. 27, 1991) 539 So.2d 685 (La. App. 1st Cir.) protects the internal communications of legislators with their staff and exempts the background information provided by legislators to their staff from public disclosure.

Based upon these authorities, I am denying your access to the records you requested.

the reporters committee for freedom of the press has this info on copsey v baer:

Legislative bodies are covered by the statute. La. Rev. Stat. Ann. § 44.1. See Times-Picayune v. Johnson, 645 So. 2d 1174 (La. App. 4th Cir. 1994), writ denied, 651 So. 2d 260 (La. 1995) (individual legislators are "custodians" of nomination forms for legislative scholarships to private university). In Copsey v. Baer, 593 So. 2d 685 (La. App. 1st Cir. 1991), writ denied, 594 So. 2d 876 (La. 1992), however, the court held that the legislative work files related to two bills from prior sessions of the Louisiana legislature were privileged from public records disclosure under the legislative privileges and immunities clause of the Louisiana Constitution, Article III, § 8. The court found that the "demand for legislative files in this case calls for an inquiry into the motivations behind the preparation and introduction of legislative instruments into the Louisiana Legislature. . . ." Id. at 689.

la. state house district 27 representative chris hazel, a former rapides parish assistant district attorney, although apparently not a very good one, because he thinks that a criminal who brings a gun to school to shoot up the student body will obey his bill not to possess body armor and which in fact rep hazel's bill makes innocent students, teachers and others sitting ducks.

whats more, chris hazel via his hb1153 says that "whoever commits the crime of wearing or possessing body armor by a student or nonstudent on school property, at a school-sponsored function, or in a firearm-free zone shall be fined not more than two thousand dollars, or imprisoned, with or without hard labor, for not less than one year nor more than five years, or both." for wearing or possessing something that could potentially save your kid's life.

hb1153 makes about as much (non)sense as "gun free zones" in which criminals can move virtually unimpeded because they know that the law-abiding possess nothing to stop them with.
