    Elmer Carl Langston
    1927 - 2010

    Funeral Services for Elmer Carl Langston will be held at 10 a.m. Wednesday, October 27, 2010 in the chapel of John Kramer & Son with Rev. Sammy Morrow officiating.

    Interment will be in Alexandria Memorial Gardens, Woodworth.

    Visitation will be held from 4 p.m. until 8 p.m. Tuesday, October 26, 2010 and from 8:30 a.m. until time of service Wednesday at John Kramer & Son.

    Elmer Carl Langston, 83, of Pollock, went to be with the Lord Sunday, October 24, 2010.

    He was born October 21, 1927 in Woodworth to the Union of Charles E. and Sophronia Langston.

    In addition to his parents, he is preceded in death by his brothers, Earl Langston, Eugene Langston, Ennis Langston and sisters, Bessie Langston, Inez Weage and Mary Gassiott.

    Elmer Langston is survived by his wife of 57 years, Merle Langston; daughter, Suzanne Langston of Shreveport; his son, Ray Anthony and wife, Rachel of Wynne, Arkansas; grandson, Jason Anthony and wife, Jessica of Pollock; one great-granddaughter, Emma; sister, Dorothy Marshall and husband, Harlan of Woodworth and brother, Ewell Langston and wife, Emma Lou of Woodworth and a host of nieces, nephews, cousins and friends.

    Elmer was a member of Pleasant Hill Baptist Church, Pollock, where he was an Adult Men's Sunday school teacher and a R.A. leader for many years.

    He was a Master Mason of Forest Hill Lodge #254.

    He served in the U.S. Navy.

    He also served as Vice President of the Louisiana Mayhaw Association for several years and founded the Springhill Development Company and was a former co-owner of the Springhill Jelly Company.

    He owned and operated Little Eden Vineyard in Pollock, a pulp wood hauler for many years and a retired sheet Metal Worker Local #361.

    Pallbearers will be: John Langston, Charles Langston, Cecil Gassiott, Lloyd Langston, Bobby Talbert and Benny Gunter.

    The family request memorials be sent to Pleasant Hill Baptist Church Building Fund, 171 Pleasant Hill Church Rd., Pollock, LA 71467.

    Honorary Pallbearers will be the Pleasant Hill Baptist Church Adult Men's Sunday school class.

    Notes of condolence may be sent to the family at kramerfunerals@aol.com.

    the dead pelican is currently running a tease (see link to read the whole thing) concerning monroe attorney, paul hurd's potential run for the louisiana attorney general's office. word of mr. hurd's potential candidacy originally appeared a few days ago on the town hall website. a hurd candidacy could add an interesting dynamic to this race and mr. hurd has always come across to us as sincere. of course you always have to watch out for a republican candidate bunch of lying bastard's that the republicans are.

    EXXON MOBIL CORPORATION, ET AL.
    PER CURIAM

    Appellants, the State of Louisiana through the Attorney General and Exxon Mobil Corporation, invoke the appellate jurisdiction of this court pursuant to La. Const. art. V, § 5(D), on the ground that the district court declared 2006 La. Act 312 to be unconstitutional.

    Pretermitting the merits, we find the issue of constitutionality was not properly raised in this case. In Vallo v. Gayle Oil Company, Inc., 94-1238 (La. 11/20/94), 646 So. 2d 859, this court explained that the unconstitutionality of a statute must be specially pleaded in the district court: Our Code of Civil Procedure does not require a single procedure or type of proceeding for challenging or assailing the constitutionality of a statute. However, the long-standing jurisprudential rule of law is: a statute must first be questioned in the trial court, not the appellate courts, and the unconstitutionality of a statute must be specially pleaded and the grounds for the claim particularized.

    The pleadings allowed in civil actions are petitions, exceptions, written motions and answers. LSA-C.C.P. art. 852.Therefore, when the unconstitutionality of a statute is specifically pled, the claim must be raised in a petition (the original petition, an amended and supplemental petition or a petition in an incidental demand), an exception, a motion or an answer. It cannot be raised in a memorandum, opposition or brief as those documents do not constitute pleadings. [emphasis added; citations and footnotes omitted].

    A review of the record indicates the issue of constitutionality was first raised in plaintiff’s “Memorandum in Opposition to Motions to Enforce Stay Provision of Act 312 or Alternatively to Extend Time in Which to File Responsive Pleadings filed by Wagner Oil Company and Parawon Corporation.” As explained in Vallo, a memorandum is not a pleading recognized under the Code of Civil Procedure and is therefore not a proper method to challenge the constitutionality of a statute.

    Accordingly, we vacate the judgment of the district court. The case is remanded to the district court to allow plaintiffs to specially plead the unconstitutionality of Act 312 and for the issue to be fully litigated. See La. Code Civ. P. art. 2164; Summerell v. Phillips, 258 La. 587, 247 So. 2d 542 (1971).

    The plaintiff, Jeanne M. Olson, purchased a piece of residential real estate, including improvements, described as 1908 Marigold Street, Alexandria, Louisiana, on February 18, 1999, for $89,594.44. When the property taxes for 1999 were not paid, the property was advertised and sold at a tax sale on May 3, 2000, to Louisiana Tax-1, Inc. More than 3 years after the sale, Ms. Olson contacted Louisiana Tax-1 in an attempt to regain her property. As a result of that contact, Louisiana Tax-1 prepared a contract, which it sent, certified-mail, return receipt requested, to Ms. Olson on September 8, 2003. The letter was returned as “Unclaimed” on September 24, 2003. Thereafter, on October 3, 2003, Louisiana Tax-1 transferred its ownership in the property to Jeff L. Melder, by execution of a “quitclaim” deed. This suit was filed October 14, 2003, naming William E. Hilton, the Rapides Parish Sheriff and Tax Collector, as the defendant. By a Supplemental and Amending Petition, Jeff L. Melder and Carolyn Ryland, Clerk of Court for Rapides Parish, were added as defendants. Subsequently, the Sheriff was dismissed.

    First, we cannot conclude from the record whether Mr. Melder is the proper defendant. His claim to the property is via quitclaim deed from Louisiana Tax-1. Louisiana Tax-1 claims title from a tax sale deed executed May 5, 2000, by Harry Vermaelen, Chief Deputy Tax Collector for Rapides Parish. However, we also find an affidavit executed by Mr. Vermaelen on April 18, 2006, wherein he states: “This property has also been adjudicated at public tax sales in 2001, 2002, [and] 2003.” That same affidavit also states: “At the tax sale of May 3, 2000, and also at the public tax sale in 2001, 2002 and 2003, action did not take place to sell any lesser portion of the property nor to sell any undivided interest.”
    [...]
    If the property was resold for taxes in 2001, 2002, and 2003, as Mr. Vermaelen’s affidavit states, who bought the property? Mr. Melder holds his title via a quitclaim deed; hence his interest is no more than the interest Louisiana Tax-1 had at the time it executed the quitclaim. If three other parties bought the property for taxes in 2001, 2002, and 2003, respectively, then Louisiana Tax-1 had no interest to convey. To be entitled to a judgment “as a matter of law” one must bring suit against the proper party. The record does not establish that Mr. Melder is the proper party defendant.

    Whether Mr. Melder is, indeed the proper party defendant; whether the property in question was sold to other parties in 2001, 2002, and 2003; whether the value of the property was made known to the bidders at the tax sale(s); and whether 100% interest in the property was the least quantity of property which any bidder would have bought for the amount of the taxes, interest, and costs due, are all genuine issue of material fact which preclude the granting of summary judgment in this case.

    anyway, seems that someone has pointed piyush's browser over to the icf website where he put his marvelous intellectual powers (and a good pocket calculator) to use.

    all this, of coz, gave piyush, ever the silly opportunist, an excuse to issue a meaningless one page letter (see link for .pdf) to governor blanco and "legislative leaders" which was promptly leaked to the notoriously pro-piyush dead pelican website which in turn obliged replete with the gigantic text headline and flashing siren.


    of course because louisianaians cant think properly, the're all cheering him on saying "atta boy piyush...way to tell 'em." it wont occur to anyone to say "hey! wait a minute your own letter states that your office receives calls about icf & the road home program daily and yet you wait until now when its supposedly going broke to look into it?" yeah thats really taking care of your constituents. maybe if piyush had been in dc (according to google maps its 16.7 miles [27 km] from the us capitol to icf's headquarters) or even in his own district...instead of gallivanting all over the state, snake charming a bunch of red neck goofs, he would have known about all this oh say about a billion dollars or so ago.

First, crime isn't an issue in lower rural Louisiana-Plaquemines Parish but survival and corruption is a major factor. The only crime in rural lower Louisiana (plaquemines parish) is corruption by Parish " Texas oil" President Nugessor and residents "finding" food and gas tanks. Billy Nungessor isn't the real Parish President of Plaquemines-this was a big oil Power Grab and the elections were fraud and held when 70% of the residents were displaced.
