joey durel to valient lafayetters: o.k. we'll let you turn right-on-red again now shut up

todays gannett/lafayette advertiser brings news that by the end of october 2009 citizens will be able to make a right-turn-on-red again. lafayette parish consolidated city government have been sold out to while the lafayette citizens have been occupied by the australian redflex corporation and their traffic scameras and "safe speed vans" for it must be two years now.

the elected officials must have figured out that fines collected for right-turns-on-red must make up only about 3 - 5% of their steady revenue stream. UPDATE: an advertiser commenter Frankie21 wrote:

Download the Redflex manual at www.camerafraud.com Sept 15th 2009. I don't see the Redflex bosses giving in on this issue. 95% of the redlight funds come from turning right on red without stopping completely.

Watch that they propose a compromise with a lower fine for right on red. Mr. Durel is caught between the Redfex money grabbers and a general public that is becoming increasingly upset that we are being scammed by our own elected officials.
plus (heres the best part) it might have the added benefit of tricking the citizenry into thinking they were listening to their concerns about redflex and taking action.

president durel, tony tramel and the rest of the pet shop bois must be under tremendous pressure over redflex and other things.

did you see this recent article from thenewspaper.com where "vigilantes" east of lafayette, in westwego, set fire to a redflex van on saturday 24 september 2009?

on the other hand, this the independent article seems to imply that president durel's handlers seem to think that he might crack-up before the next election. then what.

the newspaper.com: recent u.s. supreme court ruling spells trouble for redlight scameras

the newspaper.com has an article about the recent united states supreme court decision in melendez-diaz v. massachusetts. the the case turns on the constitutional right to confront your accuser in court.

Red light camera and speed camera manufacturers fear that last month's US Supreme Court ruling in the case Melendez-Diaz v. Massachusetts could create legal turmoil for the industry.

The National Campaign to Stop Red Light Running issued a statement yesterday warning that the ruling has armed motorists with a greater ability to challenge the basis of automated traffic citations.

Speed cameras, for example, depend heavily on legal faith in a certificate that claims to confirm the total reliability of a machine's speed reading. In the Melendez-Diaz case, the high court ruled that merely producing such a certificate in court is insufficient.

Defendants have the right to cross-examine any individual who claims to have certified evidence.

in the 2009 regular louisiana legislative session, house bill no. 480, a bill by rep. cedric richmond and rep.jeff arnold to prohibit local governments from using mounted traffic cameras to issue traffic violations in louisiana, was heard by the house transportation committee.
====

valiant lafayetter joel henderson testified to the committee and raised these same issues with them that the supreme court would agreed with him on just thirty-eight days later.

despite this, and common sense, nine australian redflex puppets on the committee voted to kill HB 480. this is the kind of criminals that we have running louisiana. they are not in the legislature to serve the people constitutionally -- they are there to serve special interests and lobbyists and government. we see this over and over...kinda like what we saw with the supreme court:
5
justice scalia wrote the opinion and he was joined by justice stevens, justice souter, justice thomas and justice ginsburg. additionally, justice thomas wrote a concurring opinion.
4
look how precariously our rights are teeter-tottering at the edge - a divided court in what should have been a no-brainer unanimous decision -- justice kennedy [ronnie raygun] wrote a very long 34 page dissent joined by chief justice roberts [jorge dubya boosh] (he's so pathetic that he cant remember the presidential oath of office - also found in the constitution, but he can remember to rule that you have no right to confront your accuser), justice breyer [william jefferson blythe clinton] and justice alito [jorge dubya boosh] in which they said that:
laboratory analysts who conduct routine scientific tests are not the kind of conventional witnesses to whom the confrontation clause refers. the judgment of the appeals court of massachusetts should be affirmed.

anti redflex scamera activism takes the wrong tact

we've been seeing that the msm has been reporting more and more about the rising frustration americans are showing towards the redlight scameras.

unfortunately, all the news accounts that we've read, so far, are about citizens attacking redflex personnel and/or property and thats just wrong.

yes the people who work for redflex (as well as all the other scamera "vendors") suck and should be encouraged instead to find honest, respectable work that they can be proud of.

odds are that you're just gonna get caught and have to pay for the damages -- plus the scamera companies have plenty of replacement parts and can always get more. so, in most cases, you're only going to slow them down for a few days, if that.

the citizenry might be more productive in their endeavors to end the redflex (and other) scam[s], if they would instead focus all their energy towards the political-governmental criminals who dont mind lining their pockets while looting -- if not the letter -- then certainly the spirit of both the federal and louisiana constitutions.

criminals who are seeking to subvert the constitution and to diminish our bill of rights have no right to hold any office in the land.

how long do you think that the scameras would last in louisiana if ... for instance, joey durel, tony tramel, la gop fraudster and alien agent, charlie buckels; the rest of the lafayette consolidated government council and the pet shop bois crime gang were afraid that everytime they stick their head out the door they're gonna get a jackhandle up side it? or how about if everytime they appear in public the crowds jeer them and spit on them?

the question that louisianans as well as the rest of americans are faced with now: is the constitution, particularly the federal constitution and bill of rights worth defending? or, are we better off as slaves?

governments at all levels no longer fear the people. in fact they are bound and determined to use the power and authority of their offices to bring the people to heel. they are systematically working a plan together to steal from and to loot the citizenry blind.

so until the people decide they've had enough and demand constitution obeying, liberty and freedom loving and god-fearing leaders, we are only going to see louisiana continue to degrade.

but all this spitting and nastiness as well as violence, bloodshed and potential loss of life is unnecessary if only those louisianaians and americans, so called, would heed second chronicles seven verse fourteen, the ancient of days has promised that he would remove these criminals for us!

'thats just wrong!' louisiana state police caught up in redflex scam

a leaked state police email shows how troop a commander capt. frank ducote is not only protecting the redflex scam but ordering his perfumed princes to do so as well.

livingston parish sheriff willie graves said "that email wasnt meant for the public to digest and understand."

on the contrary, we believe that the "public" is perfectly capable of "digesting" and "understanding" the typical louisiana corruption when we see it. we believe that sheriff graves knows this too.

whats amazing is that some in the lsp are dumb enough to put this in writing. this should have been put out at roll call.

apparently, no one in the louisiana state police has ever watched an old episode of "chips."

UPDATE: WAFB Livingston parish cancels "speed van" contract

BATON ROUGE, LA (WAFB) - The Livingston Parish Sheriff's Office says it will discontinue use of the controversial "speed van".

The sheriff's department says it decided to end its contract with Redflex, the company that owns the van, after the driver of the speed van parked it on private property without getting written permission from the owner.

HERE IS THE FULL NEWS RELEASE FROM THE LIVINGSTON PARISH SHERIFF'S DEPARTMENT:

Due to a recent series of events regarding Redflex and it's representatives, the Livingston Parish Sheriff's Office is discontinuing it's participation in the parish's photo enforcement program commonly referred to as "the speeder van." This decision was made in response to an incident that occurred Tuesday June 30, 2009 in which the driver of the speeder van parked it on private property without obtaining written permission from the property owner. This action was in direct violation of Redflex's company policy concerning the deployment of the van. The improper parking of the van resulted in it being towed at the request of a representative of the property owner. Furthermore, it was brought to the attention of Sheriff's Officials that improper comments were made to the towing company employees by the Redflex representative regarding the towing of the vehicle.

This program came into being as a result of a parish ordinance authorizing such a program as well as a contract entered into by parish government and Redflex. Although the Livingston Parish Sheriff's Office has no contractual obligation with this program, it agreed to assist in its implementation. Sheriff's officials believed then and believe now that photo enforcement can be a useful tool in addressing the growing demands placed on this office in regards to traffic safety. However, officials have concluded that any benefit derived from this program has been overshadowed by public concerns that have arisen in response to this and other recent actions of Redlfex.

On July 1, 2009, Sheriff's officials met with Parish President Mike Grimmer and informed him of the aforementioned concerns as well as the decision to no longer participate in the photo enforcement program. Parish President Grimmer expressed similar concerns and will address them with Redflex.

Therefore, effectively immediately, the Livingston Parish Sheriff's Office is discontinuing it's participation in the Livingston Parish Photo Enforcement Program. ~ source

HB 626 australian redflex owns the corrupt incompetent loony looziana louisiana legislature

on thursday, 11 june 2009, the louisiana state house of representatives debated house bill no. 626 a bill about traffic / speed limits that provides for disposition of fines for certain traffic tickets.

this bill was authored by rep. hollis downs, a major rino and if being a rino isnt bad enough, rep. downs looks to be in the pocket of the australians and their redflex traffic systems redlight scamera company.

anyway, during the floor debate, rep. jeff arnold who aint no paragon of virtue himself, proposed a germane amendment -- amendment no. #4015 (333b) which would have prohibited automated traffic enforcement systems -- redlight scameras.

click here to download the complete amendment
no. #4015 (333b) two page .pdf
====

the vote on the motion to adopt rep. arnold's amendment failed by a lop-sided vote of 25 - 56. with 22% of the state house that couldnt be bothered to vote.

next rep. arnold proposed amendment #4044 (382) which quite reasonably would have called for a vote by the people on whether to accept or reject having australians and others monitoring them and their communities and doing who knows what with the video and pictures and data of them that they are collecting and disseminating.

click here to download one page .pdf of amendment #4044 (382)

that failed 39 - 50.

14% of the house didnt even bother to vote on whether or not their constituents could vote.

you thought that you were an american with the right to vote on issues that affect you; especially issues that affect your constitutional rights and pocket book? you have nothing. you have a bunch of crooks, an organized crime gang, that calls itself the louisiana legislature who are no respecters of the people at all.

the legislature will not give the people the right to vote -- yet they can all sit at their desks, playing pocket pool and get tricked into unanimously passing a bill that the majority of them didnt want and didnt even know what was going down.

HB 480 louisiana's the redflex 9

on 18 may 2009, the louisiana state house transportation, highways and public works committee considered representatives cedric richmond and jeff arnold's house bill no. 480 which would have banned state wide the use of redlight scameras.

HB 480 redlight scamera ban bill: a first hand account of the house committee hearing

valiant lafayetter and australian redflex scamera foe joel henderson's testimony before the louisiana house of representatives committee on transportation, highways and public works, monday 18 may 2009.

====
HB 480 First-hand account of the committee meeting today

Jack Montoucet was firmly against these cameras. He told me point blank at a Clyde Holloway function recently that he was opposed to these cameras and would firmly vote against them given the chance. He point blank told me that night that it was a money making scam and everyone knew it. He got a ticket and was furious about it. He was more than 100% opposed to these cameras and let everyone know it. At least that was his position that night.

Then all of a sudden – he had a change of heart (over this past weekend I suppose). He’s re-thought his ticket experience and realized it’s changed his driving behavior . He is now for the cameras. And today he provided Redflex with a the much needed vote to kill HB 480. Having the swing vote is a very valuable thing.

So after the vote when people started to leave, I went up to Jack and asked him a simple question……..what did they give you for you to change your mind? He freaked – he started screaming at me in the committee room. And pointing his finger at me. Don’t you ever accuse me of……blah blah blah. I simply responded. Jack. It was just a simple question. Just what did you get?

Also, after the committee hearing Charlie Buckels ran up to me and started doing something really weird with his lips. Sort of a smooch noise. I guess he was saying “kiss my ass”. That’s the only thing I can think. Then he sarcastically asked how my little state court case was going. So I immediately asked him how many checks has he’s been writing out of the republican party check book to get support for his company Redflex. As you may or may not know, Charlie Buckels is the Vice Chairman of the Republican Party, and recently he was the state party treasurer.

The people were certainly out-numbered by the paid for lobbyist today. Jeff Arnold pointed out that not one person who spoke in opposition to his bill was a regular voter. That every single one of them had something to financially gain by these camera programs.

Denice C. Skinner, Lafayette Parish Republican Party District 6

HB 480 louisiana republican legislative redflex scamera puppets kill redlight camera ban bill

... republicans kill the redflex redlight scamera ban bill! ... louisiana republicans prove once again that they are indisputably the party of liars, hypocrites, thieves, con-artists, freaks, perverts and criminals ...

proving once again that our corrupt louisiana legislature is firmly controlled by corporate and special interests and does not serve the will of or the best interests of the people the house transportation, highways, & public works committee voted 7 - 9 to kill HB 480 which would have banned the australian (and other) redlight scameras.

UPDATE: sulphur, louisiana citizens drive out the australian redflex scam

repost: originally posted 26 march 2009

pay no attention to the donut snatcher in the above video. have you ever noticed how the police who are supposed to be obeying, enforcing and operating under the constitution are the first ones to toss it aside when its expedient for them to do so?

for instance, assistant chief glenn berry, stresses how having the redflex van costs the citizenry "nothing," meaning monetarily,
chief berry says that the rumor that "taxes are gonna be raised" is untrue.

however, he makes no mention of what it's costing the citizens in the loss of their constitutional rights. namely, the right to due process and the right to face your accuser. as american citizens, our birthright are the rights afforded to us by the constitution. can anyone put a price on the loss or diminishment of those rights?

this country and this state wouldnt be in the sorry shape that they are currently in, if only the people jealously guarded our constitution and demanded the same from our elected officials.

chief berry goes on to say how "this vehicle is paid for by redflex corporation, the equipment inside is paid for by redflex, the driver is trained and paid by redflex, it costs the city absolutely nothing." no one seems to stop and think about where is all the data that redflex, an australian company, is collecting going. who are they then selling or trading it to etc. in this life, no one gets something for nothing. especially when dealing with a for profit corporation.

one way to interpret what assistant chief berry is actually saying is that the sulphur police are so incompetent in enforcing the traffic laws that they have to hire an australian company to do it for them. if thats the case then the citizens of sulphur should be demanding better police management and better police officers.

    via thenewspaper.com

    excerpt:

Voters in Sulphur, Louisiana will decide next week whether to boot speed cameras from the city. A petition drive led by City Councilman Mike Koonce succeeded in calling the special election to put the question before voters on Saturday, April 4.

"Shall Ordinance No. 873, M-C Series adopting automated speed enforcement for the City of Sulphur, Louisiana, be repealed?" the ballot measure states.

If a majority of voters say yes, then the Ford Escape speed camera SUV operated by Redflex Traffic Systems will be sent packing. Last September, the city council had voted 3-2 to hire Redflex to issue speeding tickets on local roads to drivers accused of exceeding the limit by as little as 4 MPH. Redflex mails the owner of any photographed vehicle a fine that can cost as much as $350. Redflex keeps up to $32.75 for every ticket the company is able to issue.

Koonce spoke out at every city council meeting in opposition to the mayor's effort to outsource traffic enforcement to the Australian ticketing firm. ~ read more

    REDFLEX…LAFAYETTE CONSOLIDATED GOVERNMENT…
    WHAT’S REALLY GOING ON?

    by Stephanie Ware, LPI
Host of Acadiana Uncovered, 1330 KVOL A.M.

Over the last year, I have found myself in a completely different area of life than I was always used to. The day I stepped into the arena with the Valiant Lafayetteers (the opposition to the ticket extortion program), which we were named by a friend in Alexandria, was a day I will never forget. It was the day that I woke up and truly understood that government has to be watched and politicians need to be held accountable for their actions or lack thereof. The duty of citizens does not stop at the polls, unfortunately.

One example of government gone bad is the Red Light/Speedvan scam that has been placed on the heads of the good citizens of Louisiana. Politicians and bureaucrats alike, at least in Lafayette, were told by officials that this program is illegal in the State of Louisiana. And, instead of listening to those officials who knew better, Lafayette Consolidated Government and Tony Tramel, who is the Director of Traffic and Transportation in Lafayette, chose to "throw the deck up and see where the cards fall." Literally.

First and foremost, Louisiana has a specific state law (LA R.S. 32:365) prohibiting even police officers from recording vehicles in violation of traffic safety laws with citations for such violations to be mailed to the alleged violator at a later date.

So, it is baffling to know that our local politicians gave Redflex Traffic Systems permission to do what police officers themselves are prohibited from doing.

Let’s not forget the fact that the Louisiana Legislature denied legislation four times that would allow this type of program in Louisiana. However, Lafayette Consolidated Government, hiding behind their Home Rule Charter, did it anyway. I guess, as someone once said to me, it is easier to ask for forgiveness rather than permission.

Well, now our local government will need to answer to its citizens and ask for forgiveness by answering the class-action lawsuit that has been filed against it.

What is very shameful to me is that the guise Redflex tries to sell to the public is that it’s all about our safety, and we are all a bunch of lawbreakers who need to be controlled; however, it is very clear that these programs are all about creating a new revenue stream for government.

Not only is it, in my opinion, not the role of the government to control and change the behavior of its citizens, but it is also disgusting to place a sneaky new tax on the over-taxed citizens of Louisiana and tell us it’s for our benefit.

Not only did Redflex Traffic Systems, Inc. come into the State of Louisiana and violate numerous state and constitutional laws, but its salesman, Charlie Buckles of Lafayette, has continually tried to push this program by delivering inaccuracies and promises to local governments.

A little wink, wink, nod, nod and this wonderful program can be yours too! Mr. Buckles is not a registered lobbyist is he?

Before citizens decide to give in and pay the extortion notices, I encourage each one to do the research. Google is a powerful tool and much is to be found by searching "Redflex."

I also encourage the citizens of Lafayette and Louisiana for that matter, to look into the window of your government and ask yourselves, "What’s really going on?" You may want to keep one phrase in mind to help you see through the foggy glass – "Follow the money."

REDFLEX SCAM: arizona notary's commission revoked

wst... is in receipt of the following email from phil abshire:

All – Remember the story, when a complaint was filed with the Arizona Secretary of State by Mark Abshire. A notarized affidavit for the SafeSpeed Van operator was submitted by Tony Tramel in lieu of the van operator’s appearance. The document was notarized out of state, in Arizona by Cheryl A. Krough on the same day the operator was in Lafayette. Click here to download .pdf.

Here are some links to refresh your memories.

The results are that the Arizona Secretary of State has immediately revoked the notary’s commission:
click here to download four page .pdf
Mark would like to share this statement with the media and LCG –

Redflex Traffic Systems Inc. has been operating since 1997 and has contracts in over 200 U.S cities across 20 states; yet they cannot accomplish the simple task of properly notarizing a legal document for use in a civil proceeding. Either Redflex is incompetent or they along with Lafayette Consolidated Government has willfully duped Lafayette citizens into paying fines by using illegal and unethical practices.

The use of an out-of-state notary to "rubber stamp" documentation used in Louisiana civil proceedings violates laws in both the States of Arizona and Louisiana. As a result, an Arizona Notary employed by Redflex has been investigated by the Arizona Attorney General. Her notary commission has been immediately evoked in a decision by the Arizona Secretary of State on July, 3rd 2008.

Because this practice was not challenged until the end of March, 2008; all fines collected by Redflex in Lafayette, Louisiana in 2007 and 2008 that were illegally notarized in Arizona should be voided. Restitution by refunding fines to the affected individual citizens of Lafayette, Louisiana should be made immediately as it is unethical and unconscionable to collect fines by violating the laws of due process.

    Mark Abshire

It gives me great pleasure to be the one to share this news.

    Concerned citizen and Valiant Lafayetteer,

    Phil Abshire
